Conformity Assessment Application for Broadcasting and Communications Equipment (Certification and Registration)

Anyone who intends to manufacture, sell, or import broadcasting and communications equipment such as wireless devices and electronic products, or equipment that causes or is affected by electromagnetic interference, must obtain the applicable conformity assessment under Article 58-2 of the Radio Waves Act: conformity certification, conformity registration, or self-declaration of conformity. Equipment that may harm the radio environment or broadcasting and communications networks, or that causes serious electromagnetic interference, is subject to conformity certification, and other equipment is subject to conformity registration; both require testing by a designated testing agency before applying to the Director of the National Radio Research Agency. Under the Notice on Conformity Assessment of Broadcasting and Communications Equipment, conformity certification is processed within 5 days and conformity registration is processed immediately, and any change to assessed matters must be reported. Selling, or manufacturing or importing for sale, equipment that has not undergone conformity assessment is punishable under Article 84 of the Radio Waves Act by imprisonment of up to 3 years or a fine of up to 30 million won, so testing schedules and application documents should be prepared in line with the product launch schedule.

    Confirm the target category and assessment type: Check Annex 1 of the Notice to see whether the product falls under conformity certification, conformity registration, or self-declaration of conformity. Composite equipment combining certification-type and registration-type equipment follows the certification procedure, while registration-type equipment with a built-in certified wireless transmitting/receiving module may follow the registration procedure.

    Secure technical documents and coordinate testing: Obtain the user manual, exterior photos, component layout, and circuit diagrams from the manufacturer. Testing is performed by a designated testing agency under Article 58-5 of the Radio Waves Act, and the applicant uses the resulting test report in the application. An overseas manufacturer without an address or business office in Korea must designate a domestic agent in writing to apply directly.

    Prepare the identification code and application forms: First-time applicants complete the conformity assessment identification code application (Notice Form No. 2). For certification, attach a Korean user manual, test report, exterior drawings, component layout or photos, and circuit diagrams to the Conformity Certification Application (Form No. 1); for registration, prepare the Conformity Registration Application (Form No. 5) and the declaration of compliance with conformity assessment standards (Form No. 6).

    Organize derivative model and agent documents: When applying for derivative models together, attach the list of derivative models and materials on their electrical circuits, structure, and additional functions. Equipment that selectively uses parts with identical characteristics from multiple suppliers requires a parts list and evidence of identical electrical characteristics, and an application by an agent requires the agent designation (power of attorney) form (Form No. 4).

    Submit to the National Radio Research Agency and respond to requests for supplementation: Submit the application documents electronically to the Director of the National Radio Research Agency. Certification is reviewed for document adequacy, application of standards, and test report validity and processed within 5 days, and time spent verifying test report validity is not counted. A registration certificate is issued immediately for conformity registration, and certifications and registrations are published in the Official Gazette.

    Labeling, record retention, and change reports: When selling, leasing, or displaying the equipment, including online listings, apply the conformity assessment mark to the equipment or its packaging. Registrants must retain test reports, circuit diagrams, user manuals, and similar records, and must file a conformity assessment change report (Form No. 10) when assessed matters such as the model name, trade name, or components change.

A registration certificate is issued as soon as conformity registration is applied for, but if records such as test reports, circuit diagrams, and user manuals are not kept, you cannot respond to post-market requests for documents, so organize the retained records by model right after registration.
