I am an administrative agent with an office located in Songdo, Yeonsu-gu, Incheon. Here's an anecdote I thought my neighbors might find interesting. 🙂
In September, construction sites that had been on hold after the rainy season start up at once. Around this time, the word "noise" appears more frequently in emails sent to my office.
The person who sent that email was a woman in her late 20s running a small roastery cafe in the 1st floor of a downtown alley in Yeonsu-gu, Incheon. She was a second-year entrepreneur, paying off loans monthly, and half of her revenue came from customers arriving during the 7:00 AM opening.

## 1. The Excavator at 6:10 AM 🚧
Construction of a multi-family housing complex on the adjacent lot began in August. The sound of the excavator starting up shook the store's windows from around 6:00 AM.
She had already filed complaints with the National Citizen Portal and the district office twice. The answer was the same: "Measurements are within the standard, and we have taken corrective action."
Looking at the reply, both measurements were taken around 11:00 AM. The officer simply reported the numbers they measured. However, the time she was suffering was in the early morning. The noise standard for construction sites in residential areas is 5 dB lower in the morning (05-07 AM) than in the afternoon. The same noise can exceed the standard in the early morning.

## 2. Request to Send a Certified Letter in the Name of an Administrative Agent ✉️
She also sent a certified letter directly to the construction company. It was a two-page document ending with "I will take legal action if you do not compensate for business losses," and she received no response. That's when this request came: "Could you send it one more time, strongly, in the name of an administrative agent?"
I couldn't fulfill that request. Instead, I explained this:
- A certified letter only serves to record the fact that it was sent. There is no penalty for not responding.
- The place that can make the construction company change its method is the district office, which has management and supervisory authority.
- The already sent certified letter can be used as date evidence showing that you informed them from the beginning.
Article 23 of the "Noise and Vibration Management Act" allows the district office to order adjustments to working hours or reinforcement of noise reduction facilities if construction site noise exceeds the standard. The district office already had grounds to act if it only confirmed the early morning noise.

## 3. How to Prevent the Third Complaint from Being Closed 🔁
Article 23 of the "Act on Procedures for Handling Complaints" stipulates that if the same complaint is submitted more than three times without justifiable reasons, it can be closed after notifying the result twice. She had already received two responses.
Therefore, I wrote in the first paragraph what was different from the previous complaint. The measurement time zone was different, and there was new information showing the early morning noise.
The new information was from the store's CCTV. Capturing the screen with the date and time showed that the excavator started moving mostly between 6:10 AM and 40 AM for two weeks. I noted that the smartphone noise measurement app record was reference material, not an official measurement. However, the app's two-week high record wasn't from the construction site, but from the coffee grinder used when preparing for opening. 😅 I removed it from the list that day.

## 4. What Was Included in the Petition 📝
The petition should be written so that the officer can immediately see what needs to be confirmed and what actions need to be taken.
- Facts: Start date of construction, two complaints and responses (measurement times), time of nighttime work
- List of Evidence: [Exhibit 1] CCTV captures / [Exhibit 2] Two previous responses / [Exhibit 3] Certified mail and proof of delivery / [Exhibit 4] App record (for reference)
- Requested Actions: ① Measurement during morning hours ② Comparison of work hours and soundproofing facilities listed in construction notification with the actual site ③ Legal action according to law if standards are exceeded
Sentences like "It's unfair" have all been removed. You filed the complaint directly at the district office and kept the receipt. If sending by mail, you can leave the delivery date with a proof of delivery.
About ten days later, the district office came out for an early morning (6 AM) site measurement. The readings exceeded the morning standard, and the construction company was instructed to adjust work hours and reinforce the sound barrier. After that, the excavator didn't move until after 7 AM.
A few days later, a bag of coffee beans arrived. There was handwritten text on the packaging that said "Roasted after 7 AM." ☕
