Appeals against administrative dispositions

How to Object to an Individual Land Price — 30 Days From Announcement, Writing the Form 8 Objection

Individual land prices are determined by the mayor, county head or district head as of January 1 each year and announced by May 31, and they serve as the standard value for local taxes such as property tax on land and for various land price calculations. If you disagree with an announced price, under Article 11 of the Act on the Public Announcement of Real Estate Values you must submit a written objection to the city, county or district within 30 days of the announcement, and the authority must review it and notify the result within 30 days after the objection period ends. Landowners and interested parties with an objection may apply, and there is no fee.

Procedure

  1. 1. Submit an opinion during the pre-announcement review period

Before announcing individual land prices, the city, county or district prepares a review register and posts the review period and opinion submission period on its notice board or website for at least 20 days (Enforcement Decree Article 19). If you submit an individual land price opinion on Form 7 of the Enforcement Rule of the Act on the Public Announcement of Real Estate Values during this period, the authority reviews it and notifies the result within 30 days after the opinion submission period ends.

  2. 2. Check the announced price and the land characteristics survey

Individual land prices are calculated from the announced price of a standard lot with similar use value using the land price comparison table (Act Article 10(4)), so check whether the comparison standard lot is appropriate and whether the land characteristics survey is accurate. Compare the land category, zoning, actual use, road frontage, shape and terrain against the land use plan confirmation, cadastral map and site photos, and see whether the price is balanced with nearby lots.

  3. 3. Prepare and submit the objection

On the individual land price objection form (Form 8), state the location and lot number, land category, actual use, the announced price and your proposed price (won per square meter) and the grounds, and attach evidence supporting the grounds. Submit it in writing to the mayor, county head or district head where the land is located within 30 days of the announcement; it can also be filed through Government24, and there is no fee.

  4. 4. Verification, deliberation and notice of result

If necessary, the authority asks an appraisal firm to verify the price and refers it to the city/county/district real estate price announcement committee, then notifies the result in writing within 30 days after the objection period ends. If the objection is found justified, the individual land price is adjusted and announced again (Act Article 11(2)).

  5. 5. File an administrative appeal if you disagree with the result

You may file an administrative appeal within 90 days of receiving the objection result (Framework Act on Public Administration Article 36(4)), and you may also file an appeal regardless of the objection (Article 36(3)). Because the decision is made by a mayor, county head or district head, the provincial administrative appeals commission reviews it, and the petition is prepared on Form 30 of the Enforcement Rule of the Administrative Appeals Act.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • The 30-day objection period is counted from the date of determination and announcement, so check the price of your land on the city, county or district website or the real estate price lookup service right after the late-May announcement each year.
  • Under Article 4 of the Local Tax Act, the individual land price becomes the standard value for property tax on land and other taxes, so check the newly announced price every year and file an objection within the deadline for the year's announcement you wish to dispute.

Frequently asked questions

What is the deadline for objecting to an individual land price?
Within 30 days of the date of determination and announcement. Individual land prices are announced by May 31 each year, and land subdivided, merged or reclassified between January 1 and June 30 is announced by October 31 of that year, so the 30 days are counted from each announcement date (Enforcement Decree Articles 16 and 21). After the deadline, an objection to that announcement will not be accepted, so check the price right after it is announced.
Can an objection lower an individual land price that seems too high?
It is adjusted if the objection is found justified. The authority reviews the objection and, if it is justified, adjusts and re-announces the individual land price (Act Article 11(2)). Rather than simply claiming the price is high, showing with evidence problems in the choice of comparison standard lot, errors in the land characteristics survey such as zoning or road frontage, and imbalance with nearby lots gives the review a basis.
What is the difference between an opinion submission and an objection?
An opinion is submitted before announcement, and an objection is filed after announcement. An opinion is submitted on Form 7 during the review and opinion period posted for at least 20 days, and an objection is filed on Form 8 within 30 days of the announcement. Both are submitted to the mayor, county head or district head, and the review result is notified within 30 days in each case.
When will I receive the result of my objection?
Notice is given in writing within 30 days after the objection period ends. The 30 days are counted from the end of the 30-day objection period, not from the date you applied, and during that time verification by an appraisal firm and deliberation by the city/county/district real estate price announcement committee may take place. If you disagree with the result, you may file an administrative appeal within 90 days of receiving it.
What if the objection period has passed but the announced price contains an obvious error?
You can ask the city, county or district to correct the error. The mayor, county head or district head must correct without delay any miscalculation, clerical error, mistake in selecting the standard lot, error in surveying key factors such as zoning, or error in applying the land price comparison table upon discovering it (Act Article 12, Enforcement Decree Article 23). Organize documents showing the error and request a correction review.
Can an administrative agent prepare an individual land price objection?
Yes. Hwang Yunsang Administrative Office prepares individual land price opinions and objections and submits them to the city, county or district on the applicant's behalf. If you disagree with the objection result, the office also prepares and submits the administrative appeal petition in the same way.
