How to Submit the Money Lending Business Status Survey Report — June and December Reference Dates, Reports by Businesses with No Activity and Fines for Non-Submission

Under Article 12(9) of the Act on Registration of Credit Business and Protection of Finance Users and Article 7-2 of its Enforcement Decree, registered money lenders and loan brokers prepare a report as of June 30 and December 31 each year and submit it by the end of the following month (July 31 and January 31 of the next year) to the competent Mayor/Do Governor or other competent authority. The Mayor/Do Governor surveys these items as of the same reference dates and submits the results to the Minister of the Interior and Safety and the Financial Services Commission (Article 16 of the Act), so this is commonly called the money lending business status survey report. There is no provision excluding businesses with no activity, so a business with no activity also submits the report stating zero activity and the status of its business office. Failing to submit, or submitting with false or missing entries, is subject to a fine for negligence of up to 50,000,000 won and is a ground for business suspension.

Procedure

  1. 1. Confirm who must report and the reference dates

Every money lender and loan broker that keeps its registration must report. The report as of June 30 is due by July 31, and the report as of December 31 is due by January 31 of the next year, to the competent Mayor/Do Governor or other competent authority. For businesses registered with the Financial Services Commission, the Financial Services Commission is the competent authority.

  2. 2. Organize the report items and materials

A money lender states the amount lent and the number of borrowers, and a loan broker states the amount brokered and the number of counterparties brokered. In addition, the general status of the business office, lending status, brokerage status and borrowing status under Article 7-2(2) of the Enforcement Decree are stated. Lists of loan contracts, brokerage records, borrowing contracts and bank account records, and closing materials are gathered as of the reference date.

  3. 3. Preparing the report for a business with no activity

If there was no lending or brokerage during the period, the activity items are entered as 0, and the general status of the business office and financial items such as capital and borrowings are entered at their actual amounts. Not submitting the report because there was no activity is treated as non-submission, and inflating or understating activity is a false entry. Check that the figures and dates in the registration certificate, corporate register, financial materials and bank records match one another.

  4. 4. Prepare the report on the notified form and submit it

The report is prepared on the form notified by the Financial Services Commission and submitted to the competent Mayor/Do Governor or other competent authority. Submitting with all or part of the required items missing is also subject to a fine under Article 21(1)12 of the Act, so check for blanks before submission. Keep a copy of the submitted report and supporting materials for the next report and for inspections.

  5. 5. Review whether to keep the registration, close the business or take over

If there is no business activity for 6 months or more in a row, the Mayor/Do Governor or other competent authority may cancel the registration after a hearing (Article 13(2)3 of the Act). To continue the business, apply for renewal between 3 months and 1 month before the 3-year registration validity period ends; if there is no plan to operate, consider filing a business closure report and returning the registration certificate. The registration certificate itself cannot be transferred, so if another person wants to take over the business, it proceeds through a change of the corporation's shareholders and executives and a change registration within 15 days.
