How to Apply for Permission for Reinstatement of Nationality — Pledge Not to Exercise Foreign Nationality and Multiple Nationality for Overseas Koreans Aged 65 or Older

A person who lost Korean nationality by acquiring a foreign nationality can reacquire Korean nationality by obtaining permission for reinstatement of nationality from the Minister of Justice under Article 9 of the Nationality Act. Nationality is acquired when the person takes the oath of allegiance and receives the certificate of reinstatement of nationality after permission is granted, and in principle the foreign nationality must be renounced within 1 year. However, a person who lived abroad, entered Korea after reaching age 65 for the purpose of residing permanently and obtained permission for reinstatement of nationality can keep both nationalities by making a pledge not to exercise foreign nationality.

Procedure

  1. 1. Check whether the loss of nationality has been processed

A person who voluntarily acquires a foreign nationality loses Korean nationality at that time. If the loss of nationality is not reflected in the family relations register, first complete the report of loss of nationality. If the name was changed to an English name, also prepare a document showing that you are the same person.

  2. 2. Sort out your status of stay and place of residence

To apply in Korea, first make sure that you hold a status of stay such as Overseas Korean (F-4) and that your report of domestic residence or foreigner registration is in order. Check the remaining period so that the period of stay does not end while the application is pending.

  3. 3. Apply for permission for reinstatement of nationality

Submit the application for permission for reinstatement of nationality and the attached documents to the competent immigration office. The fee is 200,000 won per person and is paid by government revenue stamp. The Ministry of Justice examines the application through an identity check, a criminal record check, a military service record check and an investigation of stay activities, and may request supplementary materials.

  4. 4. Oath of allegiance and receipt of the certificate of reinstatement of nationality

Once permission is granted, you acquire Korean nationality when you take the oath of allegiance and receive the certificate of reinstatement of nationality. A person who has difficulty understanding or expressing the meaning of the oath because of age or disability can be exempted from the oath.

  5. 5. Renounce the foreign nationality or make the pledge within 1 year

Within 1 year from the date of acquiring nationality, renounce the foreign nationality or, if you are eligible, make the pledge not to exercise foreign nationality. If you do neither, you lose Korean nationality again when the period has passed. After that, proceed with the resident registration procedure.

Frequently asked questions

If I am 65 or older, can I reinstate Korean nationality while keeping U.S. citizenship?
Yes, if you meet the conditions. A person who resided abroad, entered Korea after reaching age 65 for the purpose of residing permanently and obtained permission for reinstatement of nationality can keep the foreign nationality by making the pledge not to exercise foreign nationality within 1 year from the date of acquiring nationality. If you entered before age 65 or not for the purpose of residing permanently, this provision does not apply.
How much is the application fee for reinstatement of nationality?
It is 200,000 won per person. It is paid by government revenue stamp, and minor children who acquire nationality together with the applicant (accompanying acquisition) are excluded from this amount.
In what cases is reinstatement of nationality refused?
Permission is not granted to a person who has caused harm to the State or society, a person who is not of good conduct, or a person who lost or renounced nationality for the purpose of evading military service. The same applies where the Minister of Justice finds reinstatement inappropriate for reasons of national security, maintenance of order or public welfare.
By when must I deal with my foreign nationality after reinstatement of nationality?
Within 1 year from the date of acquiring nationality. You must renounce the foreign nationality or, if you are eligible for the pledge, make the pledge not to exercise foreign nationality; if you do not, you lose Korean nationality when that period has passed.
By when must a person with multiple nationalities choose a nationality?
A person who came to hold multiple nationalities before reaching age 20 chooses before reaching age 22, and a person who came to hold multiple nationalities after reaching age 20 chooses within 2 years from that time. A person with multiple nationalities who has made the pledge not to exercise foreign nationality is excluded from this obligation, and a separate deadline applies to persons enlisted in preliminary military service.
