Pharmacy Establishment Registration: Procedure and Required Documents — Building Use, Dispensing Room and Partitioning in Mixed Stores

A pharmacy can open only after a pharmacist or oriental medicine pharmacist registers its establishment with the competent city, county or district (si/gun/gu) office (public health center) under Article 20 of the Pharmaceutical Affairs Act. The review centers on the building use, the structure of the dispensing room and drug storage, and the relationship with medical institutions. For a mixed store that also sells health functional foods, cosmetics and other goods, first decide how the pharmacy area will be partitioned.

Procedure

  1. 1. Checking the location and building use

Check whether the use shown in the building register allows a pharmacy, and if a change of use is needed, review it together with the local government's ordinance. A pharmacy cannot be opened inside a medical institution, in a space divided off from a medical institution's facilities, or in premises connected to a medical institution by a dedicated passage.

  2. 2. Listing the items to be sold

Make a list of what will be sold alongside drugs, such as health functional foods, quasi-drugs, cosmetics and medical devices. The additional reports required differ depending on whether the pharmacy founder sells them inside the pharmacy or a separate business operator runs a separate store.

  3. 3. Designing the pharmacy partitioning and dispensing room

The dispensing room is set up as an independent space, and prescription drugs are stored out of customers' reach. A pharmacy inside a supermarket or large store must be partitioned with fixed partitions or glass walls, not floor lines or movable display shelves, and it must be possible to close off the pharmacy area alone.

  4. 4. Applying for establishment registration

Apply for establishment registration at the competent public health center with the pharmacist's license, floor plan and building documents. If the partitioning or storage structure is unclear at the on-site check, you will be required to supplement or correct it.

  5. 5. Additional procedures

To make tax-free sales to foreign tourists, go through the separate procedure for designation as a tax refund store (post-purchase tax-free store). If you also run a health functional food store as a separate business, a report of that sales business is also required.

Required documents

  • Application for pharmacy establishment registration
  • Copy of pharmacist's (oriental medicine pharmacist's) license
  • Location map and floor plan of the pharmacy (showing the dispensing room and storage areas)

In the industry, fees for document preparation and partitioning review are in the range of several hundred thousand won and vary with the mixed-store partitioning and the scope of additional reports. We will advise you after a consultation based on the location and the items to be sold.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Before signing a lease, first check the building use and the structural relationship with medical institutions.
  • Do not use wording or banners on health functional food displays that could be mistaken as claiming an effect in treating disease.

Frequently asked questions

Where is pharmacy establishment registration filed?
With the city, county or district (si/gun/gu) office having jurisdiction over the location of the pharmacy; in practice the application is received by the public health center. Only a pharmacist or oriental medicine pharmacist may establish a pharmacy.
Can a pharmacy be opened anywhere in a commercial building?
The use in the building register must be suitable, and if a change of use is needed, the ordinance standards must also be checked. A pharmacy cannot be opened inside a medical institution or in a place connected to a medical institution by a dedicated passage.
Do warehouse-style pharmacies and pharmacies inside supermarkets follow the same procedure as ordinary pharmacies?
Yes. They are not a separate type of business and are subject to the same pharmacy establishment registration. However, the review centers on whether the space, sales and staff are independent from the general sales facility, so fixed partitioning and access control for the pharmacy area alone are required.
Is a separate report needed to sell health functional foods in a pharmacy?
It differs between the case where the pharmacy founder sells them inside the pharmacy and the case where a separate business operator runs a separate store. A separate business operator must file a report of health functional food sales business, and if the store partitioning is unclear, you may be required to supplement or correct it.
Can an administrative agent handle pharmacy establishment registration on my behalf?
Yes. Hwang Yunsang Administrative Office reviews the location and building use, prepares the pharmacy partition drawing and application form, files the establishment registration application and responds to requests for supplementation or correction, and prepares documents for additional reports on your behalf.
