Political Support Association Registration Documents — Register with the Election Commission within 14 Days of Designation and Report the Accountant

Persons eligible to designate a support association under Article 6 of the Political Funds Act, such as National Assembly members, local council members, and candidates and preliminary candidates in presidential, National Assembly, local council and local government head elections, may each have one support association. The representative of the association must apply for registration with the competent election commission within 14 days of the designation date, attaching the designation letter, and the commission issues a registration certificate within 7 days of receipt. Donations may only be collected after registration, so the articles, formation minutes, accountant and bank account documents should be prepared before designation.

Procedure

  1. 1. Confirm the designating person and designate the association

Those who may have a support association are limited to the central party, National Assembly members, local council members, presidential candidates and preliminary candidates, and candidates and preliminary candidates in constituency National Assembly, local council and local government head elections. A National Assembly member or local council member who already has a support association cannot set up a separate candidate support association for the same council election. The designating person gives the association a support association designation letter on Form No. 3 of the Rules on the Management of Political Funds Affairs.

  2. 2. Form the association and adopt articles and appoint a representative

At the formation meeting, the association adopts its articles or bylaws and appoints a representative. The articles must include the matters in Article 9 of the Rules, such as name, purpose and location, joining and leaving membership, collection and donation of contributions, appointment and dismissal of the representative and accountant, dissolution, and the representative and audit bodies. The name follows the format in Appended Table 1 of the Rules, such as 'National Assembly Member ○○○ Support Association'.

  3. 3. Apply to the election commission within 14 days of designation

The representative submits the registration application on Form No. 4 to the competent election commission with the designation letter, the articles, the impressions of the association seal and the representative's official seal, a copy of the formation minutes and the representative's consent to take office. The commission accepts the registration and issues a certificate within 7 days of receipt. Donations may be collected only after this registration.

  4. 4. Report the accountant appointment and bank account

The representative appoints one accountant from among persons eligible to conduct election campaigns in public elections and reports the appointment on Form No. 27 together with the registration application. The bank account for political fund income and expenditure is reported on Form No. 29, and a copy of the bankbook may be submitted instead. If the bank requires a unique identification number certificate to open an account in the association's name, the representative applies for it at the competent tax office.

  5. 5. Change registration and dissolution report after registration

If the name, location, articles, representative or seal impressions change, a change registration application is filed on Form No. 8 within 14 days. When the association dissolves, the representative must report it within 14 days, and if not reported, the election commission may cancel the registration. No dissolution report is needed when dissolution results from the end of a member's term or loss of candidate status.
