Documents for Vehicle Transfer Registration in the Name of a Religious Organization — Certificate of Unique Identification Number, Meeting Minutes, Letter of Authorization

Religious organizations such as churches, temples and mission societies are often unincorporated associations, so they register a motor vehicle by identifying the organization with its certificate of unique identification number (goyu beonhojeung). In addition to the basic transfer registration documents, the organization's bylaws, minutes of the meeting that decided to acquire the vehicle, proof of the representative, and a letter of authorization bearing the organization's official seal are needed. Transfer registration must be completed within 15 days for a sale and within 20 days for a gift.

Procedure

  1. 1. Check the name of the organization

Check whether the organization is a corporation or an unincorporated association that has received a certificate of unique identification number. Check that the organization name and representative on the certificate are still current, and if they have changed, correct the certificate first.

  2. 2. Prepare the organization's internal decision documents

Prepare minutes of the officers' meeting or church session minutes (danghoe-rok) that record the decision to buy the vehicle or receive it as a donation. Check in the articles of association or bylaws which body decides on acquisition of property, and prepare the minutes according to that procedure.

  3. 3. Prepare the basic transfer registration documents

Prepare the application for transfer registration, and for a sale the motor vehicle transfer certificate and the transferor's certificate of seal impression, or for a gift the deed of gift. Take out motor vehicle insurance in the organization's name beforehand as well.

  4. 4. Apply to the registration office

Apply to the vehicle registration office or the city, county or district (si/gun/gu) office within 15 days from the contract date for a sale, or within 20 days for a gift. If an agent files the application, also submit a letter of authorization bearing the organization's official seal and documents confirming the representative.

  5. 5. Pay acquisition tax and receive the registration certificate

Pay the acquisition tax and receive the new motor vehicle registration certificate. Acquisition tax is not exempted merely because the vehicle is in the name of a religious organization, so check the amount payable in advance.

Frequently asked questions

Can a vehicle be registered in the church's name with only a certificate of unique identification number?
In most cases additional documents are needed. The certificate of unique identification number identifies the organization, and the bylaws, minutes and proof of the representative show the organization's decision and the representative's authority. Depending on the registration office, supplementary documents may be requested.
If a church member donates a car to the church, by when must it be registered?
For a gift, transfer registration must be made within 20 days. For a sale, it is within 15 days from the contract date.
Are religious organizations exempt from motor vehicle acquisition tax?
Generally they are not. Acquisition tax on a vehicle acquisition is imposed on the same basis as for individuals and corporations, so check the amount before registration.
The senior pastor has changed. Does the vehicle have to be registered under a new name?
If the vehicle is in the organization's name, the owner stays the same. However, correct the representative on the certificate of unique identification number, and use the new representative for proof of the representative in later documents.
