How to Install a Rural Stay Shelter — 33㎡ Temporary Building Report and Farmland Register Entry Within 60 Days
A rural stay shelter is a temporary building installed on farmland by a farmer, or a person who intends to engage in weekend or hands-on farming, for direct use as temporary lodging for farm work. It must have a total floor area of 33㎡ or less, the parcel must be at least twice the combined area of the shelter and any parking space, deck and similar facilities, and the farmland must adjoin a road usable by fire trucks. After filing a temporary building report with the mayor, county head or district head, the owner applies within 60 days for a change to the farmland register.
Procedure
1. Check whether the farmland is eligible
A shelter cannot be installed on farmland designated as a disaster prevention district, a collapse risk area or a natural disaster risk improvement district. The farmland must adjoin a road where fire trucks can operate, including township, village and farm roads and de facto passages long used by residents. Farmland in an agricultural promotion zone is also eligible if the requirements are met.
2. Calculate the shelter and parcel area
The shelter's total floor area must be 33㎡ or less, and if eaves or similar parts project 1 m or more from the center line of the outer wall, the building area must also be 33㎡ or less. If a farm hut stands on the same parcel, the combined total floor area of the hut and shelter must be 33㎡ or less. The parcel must be at least twice the shelter's floor area plus any parking space and deck (including an outside septic tank), and parking spaces and decks must stay within the area set by Ministry of Agriculture, Food and Rural Affairs notice.
3. File the temporary building report
Submit a temporary building construction report with a site plan and floor plan to the mayor, county head or district head, and start installation only after reporting. If the farmland belongs to someone else, attach a consent for land use. The installation and management standards in the local building ordinance also apply, so check the ordinance before reporting.
4. Register in the farmland register within 60 days
Within 60 days of installing the shelter, apply to the head of the city, district, eup or myeon for a change of farmland use information so the shelter is entered in the farmland register. Entry in the register is one of the shelter requirements, and failure to apply is subject to a fine for negligence (1,000,000 won for a first violation).
5. Residential fire safety equipment and extension of the retention period
The shelter must have residential fire safety equipment installed. The retention period is up to 3 years, and it may be extended by up to 3 years each time for the number of times set by the building ordinance, which may be set at 3 or more times for shelters. To extend, submit an extension report with photos of the front, back and both sides taken within 1 month, no later than 7 days before expiry.
