Requirements and Procedure for Proposing an Urban Management Plan — Two-Thirds Landowner Consent, 45-Day Processing
Under Article 26 of the National Land Planning and Utilization Act, residents (including interested parties) may propose to the plan-drafting authority the drafting of an urban or county management plan for the installation and improvement of infrastructure, the designation of district unit planning zones and the establishment or amendment of district unit plans, certain use districts such as industrial and distribution development promotion districts, and urban or county planning facility multi-purpose complex zones. A proposal requires the consent of landowners covering at least two-thirds of the target land area (district unit plans and use districts) or at least four-fifths (infrastructure and multi-purpose complex zones), excluding state and public land. The mayor, county governor or other authority receiving the proposal must notify whether it will be reflected in the plan within 45 days from the proposal date, and may extend this once by 30 days for unavoidable reasons. The proposal must attach the urban or county management plan documents and a plan explanation, and the costs of drafting and deciding the plan may be borne in whole or in part by the proposer by agreement.
Procedure
1. Check what can be proposed and who drafts the plan
Proposals may cover the installation, improvement or upgrading of infrastructure, the designation or change of district unit planning zones and the establishment or amendment of district unit plans, industrial and distribution development promotion districts and use districts whose restrictions are replaced by a district unit plan, and urban or county planning facility multi-purpose complex zones. The plan-drafting authority is the competent Special City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Special Self-Governing Province Governor, city mayor or county governor; for Incheon it is the Mayor of Incheon Metropolitan City. Because an urban or county management plan must conform to the urban or county master plan, first check the direction of the master plan for the area.
2. Identify the target land and calculate the consent ratio
List the owners and area of each parcel in the proposal zone using the land register and the certified copy of the real estate register, and exclude state and public land from the consent base. Proposals for district unit plans and use districts require consent from landowners of at least two-thirds of the target land area, and proposals for infrastructure and multi-purpose complex zones require at least four-fifths. An industrial and distribution development promotion district must be at least 10,000 m² and less than 30,000 m², located in a natural green area, planned management area or production management area, with planned management areas making up at least 50%.
3. Prepare the proposal and attached documents
The proposal must attach the urban or county management plan documents (plan map and plan schedule) and a supporting plan explanation. The plan map is prepared by marking the plan on a topographic map at a scale of 1:1,000 or 1:5,000, and the plan explanation includes basic survey results and the financing plan. Detailed procedures follow the standards notified by the Minister of Land, Infrastructure and Transport.
4. Submit to the plan-drafting authority and respond to requests for supplements
Submit the completed proposal and the landowner consent forms to the urban planning division of the city, county or district office. The authority may seek the advice of the urban planning committee if necessary when deciding whether to reflect the proposal, and may request additional materials or adjustments to the plan in the process. The costs of drafting and deciding the plan may be borne in whole or in part by the proposer by agreement.
5. Notice of the decision and next procedures
The plan-drafting authority must notify the proposer within 45 days from the proposal date whether the proposal will be reflected, and may extend this once by 30 days for unavoidable reasons. If reflected, the plan documents and plan explanation attached to the proposal are used in drafting, followed by decision procedures such as hearing residents' opinions and review by the urban planning committee.

Check these first
- The consent ratio is calculated by target land area excluding state and public land, not by the number of people. If you count only the number of owners, the proposal may fall short of the requirement and not be reflected.
- An urban or county management plan must conform to the urban or county master plan. A proposal that departs from the master plan is unlikely to be reflected even if the consent ratio is met, so check the master plan before proposing.
