How to Object to a Cadastral Resurvey Boundary Decision or Adjustment Payment

In a cadastral resurvey project, once the Boundary Decision Committee decides a boundary, the cadastral authority notifies landowners and interested parties. Anyone who disagrees files a boundary decision objection with supporting evidence at the cadastral authority within 60 days of receiving the notice. If the boundary confirmation increases or decreases the land area and an adjustment payment is set, an objection may be filed within 60 days of receiving the payment notice or collection notice. Where the adjustment payment was calculated from appraisal values, two appraisal firms that did not take part in the original calculation re-appraise it, and the cadastral authority notifies the result in writing within 45 days of receiving the objection, after review and resolution by the city, county or district cadastral resurvey committee. Neither objection carries a filing fee.

Procedure

Procedure

  1. 01

    1. Check the date you received each notice and calculate the deadline — The boundary decision notice states that, if no objection is filed within 60 days, the boundary is confirmed as decided by the Boundary Decision Committee. For adjustment payments, the cadastral authority sends a payment notice or collection notice within 10 days of notifying the amount, and the 60-day objection period runs from receipt of that notice. The two deadlines run separately, so record the receipt date of each notice.

  2. 02

    2. Review the boundary-setting criteria and identify the points in dispute — The cadastral authority sets boundaries in this order: the actual boundary the owner occupies if there is no dispute over the ground boundary, the boundary found from survey records at the time of registration if there is a dispute, and then the boundary under local custom. If these methods are unreasonable, a boundary agreed by the landowners may be used. Organize when walls or buildings were erected, the boundary at the time of purchase, and the history of long-term occupation against these criteria.

  3. 03

    3. File the boundary decision objection — Submit the boundary decision objection form with the grounds and supporting documents to the cadastral authority (city, county or district). The authority forwards it with its opinion to the Boundary Decision Committee within 14 days of receipt, and the committee decides within 30 days, extendable by up to 30 days where unavoidable. The authority serves the written decision within 7 days of being notified, and the landowner must tell the authority within 60 days of receiving it whether they will challenge it through an administrative appeal or administrative litigation.

  4. 04

    4. File the adjustment payment objection — The adjustment payment is calculated as the arithmetic mean of appraisals by two appraisal firms as of the date the boundary was confirmed, or, at the request of the landowners' council, by the officially assessed individual land price after committee review. On the adjustment payment objection form, mark whether you received a payment notice or a collection notice, state your grounds and submit it to the cadastral authority. If the payment was based on appraisal values, two appraisal firms that did not take part re-appraise it, and the authority notifies the result in writing within 45 days after committee review and resolution.

  5. 05

    5. Payment, receipt and installment application — The cadastral authority pays the adjustment amount within 6 months of the payment notice, and a person who receives a collection notice pays in cash within 6 months of the assessment date. If paying at once is difficult, you may file an adjustment payment installment application with the reasons and supporting evidence, and the authority notifies its decision in writing within 15 days. Installments run within a 1-year range under the criteria in Annex 1 of the Enforcement Decree.
