Chemical Import Documents (Chemical Confirmation Statement, Import Report for Substances Hazardous to Humans, MSDS Submission)

Under Article 9 of the Chemicals Control Act, anyone who intends to import a chemical substance or a mixture containing one must confirm whether its components are existing or new chemicals, substances hazardous to humans or the environment, permitted, restricted or prohibited substances, or accident precaution substances, and submit a chemical confirmation statement to the Korea Environment Corporation; if the import is entrusted to an import agent, the entrusting party bears this duty. If the components include substances with acute or chronic human toxicity or ecotoxicity, an import report must be filed with the regional environmental office under Article 20 of the same Act (processing period 2 days), while imports of 100 kg or less per year and test, research or inspection reagents are exempt under Article 10 of the Enforcement Decree. For substances subject to MSDS under Article 110 of the Occupational Safety and Health Act, the Material Safety Data Sheet (MSDS) and the names and contents of components not meeting the classification criteria must be submitted to the Korea Occupational Safety and Health Agency before import. For substances imported at 1 tonne or more per year, also check before import whether registration or notification is required under Article 10 of the Act on the Registration and Evaluation of Chemicals.

Procedure

Procedure

  1. 01

Review the composition statement and LOC: Obtain a composition statement listing chemical names, contents and CAS numbers from the overseas manufacturer or exporter; if they refuse disclosure as a trade secret, use the chemical confirmation documents (LOC) they provide instead. Use these to check which regulated category each component falls under.

  2. 02

Submit the chemical confirmation statement: Enter the results in the confirmation statement (Form No. 1), attach the materials used, and submit it to the Korea Environment Corporation; it is processed immediately. Only substances not directly related to market release, such as test, research or inspection reagents or trial production, may be submitted within 30 days after import.

  3. 03

File the import report for substances hazardous to humans: If such substances are contained, file the import report (Form No. 23) with documents proving the components to the regional environmental office and receive the import report certificate within the 2-day processing period. First check, based on the planned annual volume and use, whether the exemptions under Article 10 of the Enforcement Decree apply.

  4. 04

Organize MSDS submission materials: For substances subject to MSDS, submit the MSDS and the names and contents of non-classified components through the KOSHA MSDS system before import. If the overseas manufacturer confirms that no classified substances exist other than those in the MSDS, submit the chemical confirmation document (Enforcement Rule of the Occupational Safety and Health Act, Form No. 62) instead.

  5. 05

Check registration and file change reports: For substances imported at 1 tonne or more per year, check before import whether registration or notification is required under Article 10 of the Act on the Registration and Evaluation of Chemicals. If the reported substance type, content or use, or the business name, representative or location changes, or the planned import volume increases by 50% or more, file a change report within 30 days of the change.

If you assume the customs import agent filed the confirmation statement, the importer still bears the fine for non-submission, because the chemical confirmation duty lies with the party that entrusted the import.
