Construction Machinery Rental Business Registration

To run a business renting out construction machinery such as excavators, forklifts and dump trucks, with or without an operator, you must register a construction machinery rental business with the mayor, county head or district head having jurisdiction over the office location under Article 21 of the Construction Machinery Management Act and Article 13 of its Enforcement Decree. One individual or corporation operating 4 or fewer units is an individual rental business, while 5 or more units or joint operation by two or more parties is a general rental business. Under Annex 14 of the Enforcement Rule, you need ownership or a right of use for the office and for a parking yard sized to the number of units, and a general business also needs office equipment and communication means for managing revenue and site deployment. The parking yard must be in an area where it does not conflict with the Farmland Act, the National Land Planning and Utilization Act or other laws and where a parking yard is permitted, and the processing period for the registration application is 10 days. If there are two or more offices, each must be registered separately and meet the standards on its own.

    Decide the business type: Based on the number of units and whether you operate jointly, choose individual (one party, 4 units or fewer) or general (5 or more units or joint operation); for joint operation, the representative and every member must own construction machinery.

    Calculate the parking yard area: Use the Annex 14 formula (24㎡ × number of non-tower-crane units to the power of 0.815 + 80㎡ × number of tower cranes to the power of 0.815), counting each crawler-type unit as half a unit.

    Check the parking yard site: Before signing for the land, use the lot number to confirm that a parking yard is permitted in the zoning, that the surface is level with an access road for transport trailers, and that it is in the same city or county as the office or an adjoining area allowed by the rules.

    Confirm parking yard possession: File an application on Form No. 29 with the mayor, county head or district head where the yard is located and receive the confirmation within the 7-day processing period; if the land is leased, attach the lease and the lessor's certificate of seal impression or confirmation of personal signature.

    Submit the registration application: File Form No. 28 with proof of machinery ownership, proof of ownership or right of use of the office, and the parking yard confirmation at the office's city, county or district, which checks the standards and issues the registration certificate within the 10-day processing period.

    After registration: Put up the construction machinery parking yard sign under Annex 14-2, check with the registration authority how to switch to rental business number plates (orange background), and sign rental contracts in writing stating the rent and period and keep them.

If you sign for parking yard land first and it turns out to be in zoning where a parking yard is not permitted, or in an area not allowed relative to the office, the confirmation will not be issued and you cannot register, so check the lot number before signing.
