Defense Materiel and Defense Contractor Designation Application

A company that intends to produce defense materiel must meet the facility standards and security requirements and be designated as a defense contractor by the Minister of Trade and Industry under Article 35 of the Defense Acquisition Program Act; the Minister consults the Minister of the Defense Acquisition Program Administration (DAPA) before designating. If the military supply to be produced is not yet defense materiel, the company may first request DAPA to designate it under Article 39(3) of the Enforcement Decree, and DAPA decides and notifies within 3 months whether designation is appropriate. On receiving a contractor designation application, the Minister of Trade and Industry measures the production facilities against the facility standards, asks DAPA to have the security requirements measured, and notifies the decision within 6 months (Article 41 of the Enforcement Decree). Companies producing materiel listed in Article 35(2) of the Act, such as firearms, guided weapons, aircraft, naval vessels and ammunition, are designated as major defense contractors; others are designated as general defense contractors. Designation is barred where a former officer of a contractor whose designation was revoked (including spouse and lineal relatives) is an officer within 3 years of the revocation, or where an application uses the same site and facilities within 6 months of revocation (Article 47 of the Act). Hwang Yunsang Administrative Office prepares the defense materiel designation request, the defense contractor designation application and attachments such as the production facility statement and business plan, and handles submission on the client's behalf.

Procedure

Procedure

  1. 01

Check defense materiel status: Confirm whether the product has been designated as defense materiel by DAPA and whether it is major or general defense materiel. Designation is in principle made per finished product or major component; parts and assemblies qualify only if they contain core or defense industry technology or were developed through the parts localization program (Article 40 of the Enforcement Decree).

  2. 02

Submit a defense materiel designation request (undesignated items): Complete the request form (Form No. 3 of the Enforcement Rule) with the operational concept, specifications, development status, localization record and plan, production record and capacity, and need for designation, and submit it to DAPA. Items that two or more domestic companies are judged able to produce may not be designated, so the need for designation should be explained concretely.

  3. 03

Prepare the production facility statement and records/plans: Prepare the statement and capability description of production facilities and major auxiliary facilities, the raw material usage record and procurement plan, and the type, specifications, production and sales record and plan of products. The facility standards cover general and special facilities, quality inspection facilities and technical personnel as set by the Minister of Trade and Industry (Article 42), so the statement is organized along those items.

  4. 04

Prepare the business plan, technical personnel and safety plans: Prepare the business plan, the training plan and technical capability description for engineers and technicians, and the safety measures plan and description. Security requirements comprise 9 items including site security, personnel security, handling of classified documents, protection of materials and equipment, communications and data processing (Article 44(1)), so site security measures are checked before applying.

  5. 05

File the contractor designation application and respond to inspections: Submit the application (Form No. 4) with attachments to the Minister of Trade and Industry and respond to the facility measurement and the security measurement conducted by the Minister of National Defense via DAPA. Upon designation a certificate (Form No. 5) is issued; an existing defense contractor adding other defense materiel attaches only the 4 documents from the facility statement to the business plan.

Contractor designation is granted to those producing defense materiel, so an undesignated product cannot support designation; schedule the DAPA designation request (notice within 3 months) and the Ministry of Trade and Industry application (within 6 months) in sequence to fit delivery plans.
