Marriage Immigrant Permanent Residence (F-5-2) Change

Under Annex 1-3, Item 2 of the Enforcement Decree of the Immigration Act, a Marriage Immigrant (F-6) foreign national who is the spouse of a Korean national and has stayed in Korea for 2 years or more may apply to the immigration office with jurisdiction over the place of stay for a change to Permanent Residence (F-5-2). The review covers good conduct, livelihood and basic knowledge under Article 10-3(2) of the Immigration Act, together with the period of stay. Income is assessed against the previous year's gross national income (GNI) per capita published by the Bank of Korea and is proved with public records of the applicant's and the Korean spouse's income, and basic knowledge is proved through completion of the Social Integration Program or the comprehensive evaluation for permanent residence. Fines or violations of the Immigration Act affect the good conduct review depending on their nature and the time elapsed, and the permanent residence card issued after approval is valid for 10 years under Article 33 of the same Act.

Procedure

Procedure

  1. 01

Check the stay history: Check from immigration records whether the applicant has stayed in Korea for 2 years or more with marriage immigrant status after marriage. If there were long absences or intermediate changes of status, check whether they affect the calculation of the period of stay.

  2. 02

Organize income records: Check the income of the applicant and the Korean spouse with income amount certificates or earned income withholding receipts. Cash wages and unreported income are hard to have recognized, so check whether income proved by public records exceeds the standard.

  3. 03

Prove basic knowledge: Check materials already held, such as a Social Integration Program completion certificate or a pass certificate for the comprehensive evaluation for permanent residence. If not yet obtained, plan the course and evaluation schedule around the application date and the expiry date of stay.

  4. 04

Check good conduct: If there is a history of fines or Immigration Act violations, check the dates and details of the dispositions. Because the time elapsed since a disposition may affect the review, decide the application timing after reviewing that history.

  5. 05

Prepare and submit documents: Prepare the integrated application form and proof of identity, marriage, income, basic knowledge and place of stay, book a visit on HiKorea and apply to the competent immigration office. Check the expiry date so that the period of stay does not end during review, and respond to supplement requests.

  6. 06

Post-approval management: With permanent residence, no extension of stay is needed, but the permanent residence card must be reissued every 10 years. When moving, report the change of the place of stay within 15 days of moving in.

If it is not checked whether the current period of stay needs to be extended separately from the permanent residence application, the period of stay may end during review, so check whether an extension is needed before the expiry date.
