Imported Agricultural Machinery Inspection Application

Agricultural machinery listed in Annex 4 of the Enforcement Rule of the Agricultural Mechanization Promotion Act, such as agricultural tractors, combines and rice transplanters, must pass an inspection by the Minister of Agriculture, Food and Rural Affairs under Article 9 of the Agricultural Mechanization Promotion Act before an importer or manufacturer sells it, and used agricultural machinery brought in by an importer is also covered. The inspection application is filed with the Korea Agriculture Technology Promotion Agency together with the specification and performance statement, exterior drawing, user manual and the product for inspection. The processing period is 45 days for a comprehensive inspection, 30 days for a safety inspection and 20 days for a change inspection, and periods for providing materials on request, supplementing documents or waiting for suitable test conditions are not counted. Machinery for research and development or export is exempt, but an application for a model of the same type that has already been inspected may be returned. Selling or distributing machinery that has not been inspected or was found nonconforming is subject to a fine for negligence of up to KRW 10 million.

    Check whether the model is covered: Compare each model and type with Annex 4 of the Enforcement Rule to see whether it falls under the comprehensive inspection or the safety inspection, and check whether it is exempt because it is for research and development or export.

    Cross-check the foreign manufacturer's materials: Match the type name, engine output, weight and dimensions across the manufacturer's catalog, specification sheet and nameplate photos, and check whether the same type has already received a conforming decision, to remove grounds for return in advance.

    Prepare the application and performance statement: Prepare the inspection application (Form No. 2) and the specification and performance statement, and organize the exterior drawing and user manual. For agricultural tractors, combines and agricultural forklifts, attach a copy of the engine emission certificate; for a change inspection, prepare a document describing the change and its reason.

    Submit to the Agency and respond to supplement requests: The administrative office submits the application and attachments together with the product for inspection to the Korea Agriculture Technology Promotion Agency on your behalf and explains the fee payment. If a supplement is requested, supplementary documents with figures matched to the same manufacturer data are prepared and filed.

    Inspection testing: The Agency tests structure, performance and safety under the published inspection standards. Machinery that must be tested in fields or on site may be delivered at the time of testing, and any period during which the Agency requests materials or a performance test site is excluded from the processing period.

  6. 06

    Receive the report and follow-up: After receiving a conforming inspection report, the importer attaches the inspection certificate label to machinery of that type, and collects the product submitted for inspection within 30 days of notice. If the trade name, principal office address or type name changes, a change report is filed with the Agency within 30 days.

If you check whether the machine is subject to inspection only after signing the import contract, supplement and material-provision periods are added to the processing period and you may miss the selling season, so check Annex 4 coverage and the range of specification data the foreign manufacturer can provide before signing.
