Fee-Charging Job Placement Business Registration

Anyone who wants to charge fees for placing workers between employers and job seekers must register a fee-charging job placement business under Article 19 of the Employment Security Act. If the workers will work in Korea, registration is made with the head of the Si/Gun/Gu that has jurisdiction over the main business office; if they will work overseas, registration is made with the Minister of Employment and Labor (the employment security office with jurisdiction over the main business office). An individual must hold one of the qualifications listed in Article 21 of the Enforcement Decree, such as a Grade 1 or 2 Vocational Counselor certificate, at least 2 years of service as a national or local public official, or a social worker certificate; a corporation must be a company or cooperative (excluding social cooperatives) established for the purpose of job placement, with paid-in capital of at least KRW 50 million (plus KRW 20 million for each additional office) and at least 2 qualified officers. The applicant must also have an office with an exclusive floor area of at least 10 square meters, at least 1 vocational counselor per office, and a guarantee insurance policy or deposit of KRW 10 million per domestic office or KRW 100 million for overseas placement, and the processing period for the application is 15 days. A person who falls under the disqualification grounds of Article 38 of the Act, such as a minor, a person for whom 2 years have not passed since completing a sentence of imprisonment without labor or heavier, or a person for whom 5 years have not passed since a registration was revoked, cannot register.

Procedure

Procedure

  1. 01

Domestic or overseas classification and disqualification check: Classify the business as domestic or overseas based on where the placed workers will work, and check whether the representative and officers fall under the disqualification grounds of Article 38 of the Act (minor, less than 2 years since completing a sentence of imprisonment without labor or heavier, less than 5 years since revocation of registration, etc.). Also check whether any business prohibited from being run concurrently under Article 26, such as a marriage brokerage or lodging business, is being operated.

  2. 02

Organizing proof of the representative's and officers' qualifications: Collect documents proving the applicable item of Article 21(1) of the Enforcement Decree, such as a copy of a Vocational Counselor certificate, a public service career certificate, a social worker certificate, or a career certificate showing at least 2 years of vocational counseling work. For a corporation, also check the purpose stated in the articles of incorporation, the paid-in capital, and that at least 2 officers are qualified.

  3. 03

Checking the office and vocational counselor requirements: Use the lease agreement and building records to confirm that the office's exclusive floor area is at least 10 square meters, and check that each office has at least 1 vocational counselor qualified under Article 19 of the Enforcement Rule. If the representative is qualified and works full-time at that office, a separate vocational counselor does not need to be hired.

  4. 04

Preparing the registration application and staff register: Fill in the registration application (Enforcement Rule Form No. 14) with the office name, location, exclusive floor area, main occupations placed, and any concurrent business, and prepare the staff register (Form No. 15). For overseas placement, add a business plan (Form No. 8), and if the applicant or an officer is a foreign national, prepare home-country documents proving no disqualification ground applies.

  5. 05

Filing with the competent authority and proof of guarantee insurance: Our administrative office files the application and attachments on the client's behalf with the Si/Gun/Gu office for a domestic business or the competent regional employment and labor office for an overseas business. Proof of guarantee insurance, mutual-aid enrollment, or a deposit must be submitted by the time the registration certificate is issued, and the guarantee insurance must name the head of the registering authority as the insured.

  6. 06

Change registration and guarantee renewal after registration: If the office name, number of offices, location, representative or officers, staff register, or concurrent business changes, file a change registration application (Form No. 12) within 30 days of the change. When the guarantee insurance period ends, renew it by the expiry date and submit the proof to the registering authority within 10 days.

Starting fee-charging placements before receiving the registration certificate is punishable as an unregistered business, and because a job placement advertisement must state the registration number, no advertisement can be placed before registration either, so the opening date should be set after the certificate is issued.
