Procedure
Procedure
- 01
Confirm the substance and business type: Check whether the nicotine content of each product exceeds the threshold in the Chemical Safety Institute designation notice for acutely toxic substances, and, if the product is imported, whether the import report for hazardous substances under Article 20(2) applies. Selling substances built into machines or devices is exempt from the permit under Article 29, while selling only reagents for testing, research or inspection is subject to the Article 29-3 report.
- 02
Decide between permit, business report and sales report: Compare the maximum holding quantity at the site with the specified quantity for each substance. At or above the lower specified quantity is a business permit; at or above the lowest but below the lower specified quantity is a business report; selling without installing or operating handling facilities is a sales business report. Stock kept in a shop or warehouse counts as a handling facility, so decide the storage location and maximum holding quantity first.
- 03
Check facilities and prior procedures: If you keep a storage facility, prepare the items in Appendix 6 of the Enforcement Rule, such as a changing room, personal protective equipment, fire-fighting equipment, and a leak detection and alarm device or CCTV. At or above the lower specified quantity, the application must include a chemical accident prevention management plan with a conformity notice and an installation inspection result judged conforming under Article 28(1), so complete both before applying.
- 04
Submit the application or report: A business permit uses the application in Annex Form No. 43 with the annual handling quantity data, the handling facility statement and the equipment and technical personnel statement, filed with the competent local environmental office. A business report uses the same Form No. 43 with the inspection result, the annual handling quantity data and the facility statement, and a sales business report uses Form No. 47-3 with the annual handling quantity data. The business registration certificate and corporate registry extract are checked through shared administrative information if you consent, so you need not attach them.
- 05
Receive the certificate and appoint the manager: After a permit or business report you receive the document in Form No. 45, and after a sales business report you receive the report confirmation certificate in Form No. 47-4. Under Article 32 the operator appoints a hazardous chemical manager before starting business and reports the appointment without delay; the required number depends on handling quantity and workforce under the Enforcement Decree, so it is confirmed for each business type.
- 06
Notice to buyers and changes after launch: When selling, the operator must inform the buyer under Article 29-2, by container labeling or the information summary in Form No. 47-2, that the product is a hazardous chemical and that handling standards apply. A change in facility capacity, location or substance requires a change permit or change report, and a change report is in principle filed within 30 days of the change on Form No. 46.

If you file a sales business report on the basis of having no handling facilities but then stock nicotine liquid in the shop or warehouse, you may exceed the scope of that report and fall under a business permit or business report, so decide the storage location and maximum holding quantity first and then choose the report type.
