Hazardous Chemical Transport Business Permit (incl. Vehicle Installation Inspection and Manager Appointment)

Anyone who intends to transport more than 1 ton of hazardous chemicals at a time must obtain a hazardous chemical transport business permit from the competent River Basin (Regional) Environmental Office for each place of business under Article 28 of the Chemicals Control Act and Article 27 of its Enforcement Rule; the processing period for the permit application is 15 days. Transport vehicles are handling facilities under Article 2 of the Act, so they must first pass the installation inspection under Article 24, and because a copy of the freight vehicle transport business permit or construction machinery rental business registration certificate is attached to the application, the transport business permit should be secured first. Under Article 19 of the Enforcement Rule, vehicles that transport hazardous chemicals are excluded from the chemical accident prevention and management plan requirement, but loading and unloading are not covered by this exclusion, so facilities at loading and unloading sites are checked separately. Persons who only handle and transport within a defined area such as a port or railway station yard are exempt from the permit under Article 29, and a person falling under the disqualification grounds of Article 30, such as one whose permit was revoked less than 2 years ago, cannot obtain the permit.

Procedure

Procedure

  1. 01

Confirm whether a permit is required: Check whether the substance is an acute human toxic, chronic human toxic, ecotoxic or accident precaution substance and whether more than 1 ton is transported at a time. Substances built into machinery, reagents for testing, research or inspection, and handling and transport within a defined area such as a port or station yard are exempt under Article 29.

  2. 02

Check the transport business permit and disqualification grounds: Since a copy of the freight vehicle transport business permit or construction machinery rental registration certificate goes into the application, confirm the transport business permit first. Also check that the representative and corporate officers do not fall under Article 30 disqualification grounds, such as undischarged bankruptcy or less than 2 years since a permit revocation.

  3. 03

Prepare facilities and equipment: Under Annex 6 of the Enforcement Rule, provide a parking lot large enough for the transport vehicles, a vehicle washing facility with a sump to collect wastewater, a changing room, personal protective equipment for every worker, fire extinguishing equipment and similar items. The technical personnel standard in the same Annex does not apply to the transport business.

  4. 04

Vehicle installation inspection: Transport vehicles are handling facilities, so they undergo installation inspection by an inspection body under Article 22 of the Enforcement Rule, such as the Korea Environment Corporation, to obtain an inspection report with a pass decision. Vehicles without a pass decision cannot be used for transport, and after the permit, periodic inspections follow at intervals of up to 3 years set by public notice.

  5. 05

Submit the permit application: Attach the annual expected handling quantity data, a handling facility specification listing each vehicle's capacity, the equipment specification, the installation inspection report and a copy of the transport business permit to the application in Form No. 43 and file it with the River Basin (Regional) Environmental Office for the place of business. The processing period is 15 days, and any request for supplementation is answered within the given period.

  6. 06

Manager appointment and later changes: Before starting business, appoint one hazardous chemical management officer and one inspector per 20 transport vehicles (the inspector may be omitted for 20 vehicles or fewer), and report the appointment using Form No. 49. If transport facility capacity increases by a cumulative 50% or more after the permit, a change permit is required; smaller fleet increases or a change of vehicle type require a change report.

Transporting without a change permit after fleet additions have raised transport facility capacity by a cumulative 50% or more over the permitted level is subject to penalties under Article 61 of the Act, so calculate the cumulative increase since the permit before adding vehicles and determine whether a change permit or a change report applies.
