Health Functional Food General Sales Business Report

To sell health functional food anywhere other than a pharmacy, you file a general sales business report for each place of business with the head of the city, county or district office that has jurisdiction over it, under Article 6(2) of the Health Functional Foods Act. You must complete 2 hours of safety and hygiene training before filing, and the office must tell you within 3 days whether the report is accepted. If you also sell medical devices such as blood pressure monitors or thermometers, a separate sales business report under Article 17 of the Medical Devices Act goes to the same district office, and online sales call for a separate check of the mail-order business report. Once the report is accepted, a business report certificate is issued, so keep it at the store.

  • Notification Difficulty Low

You submit the statutory report form and required documents. Once the documents are in order the report is accepted; for some reports the authority checks the contents before accepting it.

  1. 01

    1. Confirm the sales method and the report category: Selling health functional food made by others in a store, door to door or online is general sales business. Selling products made by a contract manufacturer under your own brand is a separate distribution-only sales report. Sales at a pharmacy registered under the Pharmaceutical Affairs Act or at a custom-made health functional food outlet do not require a general sales report. If you plan to sell medical devices too, check at this stage whether the items are exempt from the sales business report.

  2. 02

    2. Complete 2 hours of safety and hygiene training: Anyone starting a general sales business must take 2 hours of safety and hygiene training before filing (Enforcement Rule Article 19(3)). If you start the same type of business within 2 years of the training date, you need not repeat it. After opening, you take 2 hours of training every year for each place of business.

  3. 03

    3. Check the facility standard: In principle the business needs its own independent place of business, but if business operations are not affected it may share another place or keep only an office (Enforcement Rule Table 1). Door-to-door, telephone solicitation, multi-level and e-commerce or mail-order sales, where buyers do not visit the office, may use a residential building as the office. If you open a store, check before signing the lease that the use recorded in the building register allows retail.

  4. 04

    4. Submit the business report form: Attach proof of training completion to the business report form (Form No. 6) and submit it to the business report department of the city, county or district office where the premises are located, or apply through Government24. The office checks disqualification grounds through administrative data and must notify you within 3 days whether it accepts the report. If no notice is given within that period, the report is deemed accepted on the day after the period ends. Once accepted, a business report certificate (Form No. 8) is issued.

  5. 05

    5. File the medical device sales report and the mail-order report together: If you also sell or rent out medical devices such as massage chairs, blood pressure monitors or thermometers, submit a medical device sales (rental) business report (Form No. 36) for each place of business to the same district office, separately. Processing takes 3 days and no documents are specified for the applicant to attach. A person who has filed a sales report need not file a rental report again. If you sell online, also check whether you must file a mail-order business report under Article 12 of the E-Commerce Act.

If the business name, representative or location changes, file a change report (Form No. 13); if you close the business, submit a closure report (Form No. 14) within 1 month of the closing date. The medical device sales business also needs its own change, suspension and closure reports. Because sellers of health functional food must take 2 hours of safety and hygiene training every year for each place of business, track the training schedule after filing.
