Drafting a Statement of Explanation for Ineligible Regional Housing Association Members

Under Article 21 of the Enforcement Decree of the Housing Act, a member of a regional housing association must, from the date of application for association establishment approval (one year before that date in a speculation-overheated district) until the date occupancy becomes possible, be the head of a household in which no member owns a house, or the head of a household in which only one member owns a single house with an exclusive residential area of 85 square meters or less, and must have resided continuously in the same region for 6 months or more as of the application date. The mayor, county head or district head checks member eligibility through the housing computer network at establishment approval (including amendment approval), project plan approval and use inspection (Article 8 of the Enforcement Rule of the Housing Act), and if a member is found ineligible, the project operator notifies the result and sets a period of at least 7 days from the notice date to receive explanatory documents (Article 52 of the Rules on Housing Supply). Houses and pre-sale rights held by a spouse registered at a separate address and that spouse's household members also count as ownership, but there are exceptions, such as a house acquired by inheritance, bequest or marriage that is disposed of within 6 months of receiving the notice. If the explanation is not accepted and the member is confirmed as unqualified, membership is lost and the association may fill the vacancy with a new member.

Procedure

Procedure

  1. 01

Check the grounds and deadline: Confirm whether the ineligibility notice cites house ownership, the household-head requirement, residence period, or duplicate membership in another housing association. The project operator sets an explanation period of at least 7 days from the notice date, so record the submission deadline and the date you received the notice.

  2. 02

Check the reference dates and household members: House ownership is assessed from the date of application for establishment approval (one year earlier in a speculation-overheated district) until the date occupancy becomes possible, and residence period as of the application date. For members who joined to fill a vacancy, the date of the membership application is the reference date, and houses owned by a separately residing spouse and that spouse's household members are also searched.

  3. 03

Review exceptions: A house acquired by inheritance, bequest or marriage is treated as not owned if it is disposed of within 6 months of receiving the ineligibility notice. Otherwise, Article 53 of the Rules on Housing Supply applies mutatis mutandis, so check whether the case involves a house owned by a lineal ascendant aged 60 or older, a single house of 20 square meters or less, or an abandoned or demolished house, and whether household-head status was lost and regained due to work, medical treatment, study or marriage.

  4. 04

Organize the evidence: The time of ownership and disposal is the earlier of the registration receipt date on the building registry certificate and the processing date on the building ledger, so obtain both documents. Residence period is shown by the move-in and move-out history on the resident registration abstract, and spousal relationship and divorce date by the family relation certificate and marital relation certificate.

  5. 05

Draft and submit the statement: For each ground of ineligibility, set out the legal provision, reference date, facts and attached evidence numbers in order so the case can be decided on the documents alone, then submit to the association within the deadline and keep proof of receipt. If a house is to be disposed of, state the disposal plan and submit the updated building registry certificate after disposal.

The 6-month disposal period for a house acquired by inheritance or marriage runs from the date the ineligibility notice is received, and member eligibility is searched again at project plan approval and use inspection, so record the date you received the notice, set the disposal schedule immediately, and check the effect on eligibility before acquiring a house or changing your household composition until the date occupancy becomes possible.
