Medical Institution Establishment Report and Permit

Under Article 33(3) of the Medical Service Act and Article 25 of its Enforcement Rule, a clinic, dental clinic, Korean medicine clinic or midwifery clinic files an establishment report with the mayor, county head or district head (public health center) having jurisdiction over its location, and receives a Medical Institution Establishment Report Certificate once the report is accepted. A hospital, dental hospital, Korean medicine hospital, long-term care hospital, psychiatric hospital or general hospital must obtain an establishment permit from the city/provincial governor after a preliminary review and a main review by the city/provincial Medical Institution Establishment Committee, and the permit cannot be granted if the facility standards are not met or the plan does not fit the hospital bed supply and management plan. Only medical personnel, the State and local governments, medical corporations, non-profit corporations, quasi-governmental institutions and others specified by law may establish a medical institution, and a medical professional may not establish or operate two or more medical institutions. A medical institution cannot be established inside or within the premises of a pharmacy, in a space connected to a pharmacy by a dedicated passage, or in a building constructed, extended or rebuilt without the required permit or report.

Procedure

Procedure

  1. 01

Check eligibility and institution type: A doctor may open a clinic, hospital, long-term care hospital, psychiatric hospital or general hospital; a dentist a dental clinic or dental hospital; a Korean medicine doctor a Korean medicine clinic, Korean medicine hospital or long-term care hospital; and a midwife only a midwifery clinic. A medical corporation or non-profit corporation must first obtain approval from the competent authority to amend its articles of incorporation to include the location of the institution.

  2. 02

Check the premises: Before signing a lease, check the building register for unauthorized extension or rebuilding and for the building use, and confirm the space is not within a pharmacy or connected to one by a dedicated corridor, stairway or elevator. The fire safety facilities required for medical institutions are also checked at the time of the report.

  3. 03

Clinic-level establishment report: Submit the Medical Institution Establishment Report with copies of the floor plan and structural description and documents proving compliance with the facility standards and other requirements to the city, county or district office (public health center). Once the establishment standards, compliance items and fire safety facilities are confirmed and the report is accepted, the Medical Institution Establishment Report Certificate is issued.

  4. 04

Hospital-level preliminary review: Submit the application for preliminary review of the establishment permit and a business plan to the city/provincial governor, and the Medical Institution Establishment Committee reviews the regional bed count and whether the establishment standards are violated. A general hospital also needs approval from the Minister of Health and Welfare at this stage, and the committee sets the validity period of the preliminary approval within 3 years.

  5. 05

Hospital-level main review and permit: Within the validity period of the preliminary approval, submit the establishment permit application with the preliminary review approval certificate, floor plan and other documents. After a main review of whether key matters such as the number of beds and medical departments match the preliminary review, the Medical Institution Establishment Permit is issued.

  6. 06

Managing changes after opening: Relocation, a change of founder, name, medical departments or number of medical personnel, and treatment by another doctor while the founder is hospitalized or on an overseas trip require a report of change (a change permit for hospital-level institutions). Closing the institution or suspending operations for 1 month or more must also be reported to the city, county or district office.

A medical institution cannot be established in a building with any part extended or rebuilt without a permit or report, so the process can stall at the reporting stage after interior work is done; check before signing the lease that the building register matches the actual condition of the building.
