Overseas Emigration Agency Registration

Anyone who wishes to recruit or arrange emigrants, or to carry out as a business the filing of emigration reports on behalf of others, applications for emigration entry visas on behalf of others, emigration consultation and guidance, or settlement support for emigrants, must register an overseas emigration agency business with the Commissioner of the Overseas Koreans Agency under Article 10 of the Emigration Act. Only corporations may register, and they must meet both registration requirements under Article 16 of the Enforcement Decree: paid-in capital (basic property for non-profit corporations) of KRW 100 million or more and a guarantee insurance policy with an insured amount of KRW 300 million or more. A corporation is disqualified if any officer is serving or has not been exempted from a sentence of imprisonment without labor or heavier, is under a suspended sentence, or was an officer of a corporation whose registration was cancelled less than 3 years ago. The Overseas Koreans Agency checks the disqualification grounds and requirements before issuing a registration certificate; the processing period stated on the application form is 20 days and there is no application fee.

Procedure

Procedure

  1. 01

Confirm the business scope: Identify which of the activities in Article 10(1) of the Emigration Act (recruitment and arrangement, emigration report filing, emigration entry visa applications, consultation and guidance, settlement support) will be carried out as a business. Emigration consultation alone requires registration, and operating without registration is punishable by up to 5 years' imprisonment or a fine of up to KRW 50 million.

  2. 02

Check corporate and officer requirements: Use the corporate registry certificate to confirm corporate status and the officers, and check each officer against the disqualification grounds. Also confirm that the articles of incorporation include the overseas emigration agency business and that paid-in capital (basic property for non-profit corporations) is KRW 100 million or more on the statement of financial position.

  3. 03

Obtain guarantee insurance: Take out guarantee insurance with a guarantee insurer established under the Insurance Business Act, with an insured amount of KRW 300 million or more, a term of 1 to 3 years, and the Commissioner of the Overseas Koreans Agency as the insured, covering losses to prospective emigrants from non-performance of contracts (Article 8 of the Enforcement Rule).

  4. 04

Prepare the business plan and attachments: Set out in the business plan the scope of arrangement services, the premises and staff, and the standards for arrangement fees and commissions, and arrange the articles of incorporation, statement of financial position, proof of guarantee insurance, and a document listing officers' names and resident registration numbers in the order of the application form.

  5. 05

File the application and respond to requests: Submit the registration application (Form No. 6 of the Enforcement Rule of the Emigration Act) to the Commissioner of the Overseas Koreans Agency; the official checks the corporate registry certificate through shared administrative information. The processing period is 20 days; respond to any supplementation request within the deadline and receive the registration certificate (Form No. 7).

  6. 06

Post-registration display and changes: Display the registration certificate and the arrangement fees and commissions at each place of business. If the representative or officers, trade name, head office location, or articles of incorporation change, file a change registration application (Form No. 8) within 1 month. Renew the guarantee insurance before it expires and submit proof within 10 days of renewal to have the registration certificate renewed.
