Private Sewage Treatment Facility Design and Construction Business Registration

To run a business designing and constructing private sewage treatment facilities such as septic tanks and sewage treatment units, the facilities, equipment and technical personnel set out in Appended Table 4 of the Enforcement Decree must be secured and the business registered with the mayor, county head or district head having jurisdiction over the office location under Article 51 of the Sewerage Act. The registration standards are an office and laboratory, test equipment for 6 measurement items, drafting equipment or a CAD computer, and four technical personnel (one civil or architectural, one mechanical or electrical, and two water quality or chemical), and with a measurement agency contract the test equipment or laboratory may be omitted. The application is made on Form No. 29 of the Enforcement Rule of the Sewerage Act, and the processing period is 10 days. Persons falling under the disqualification grounds of Article 48, such as adults under guardianship, bankrupts, or those sentenced to imprisonment for violating the Sewerage Act, the Water Environment Conservation Act or the Wastes Control Act within the past 2 years, cannot register, and changes to the trade name, technical personnel, representative, office or laboratory location must be reported within 30 days.

    Check whether registration is required: Anyone who designs and constructs private sewage treatment facilities such as septic tanks and sewage treatment units as a business must register under Article 51 of the Sewerage Act. Holders of certain construction business registrations, the relevant environmental specialty construction registration, or a treatment facility design and construction registration under the Livestock Excreta Act may do this work without it, so existing registrations are checked first.

    Match the four technical personnel: Under Appended Table 4 of the Enforcement Decree, one person with civil or architectural industrial engineer qualification or higher, one person in the mechanical or electrical field such as general machinery engineer or electrical industrial engineer, and two persons with water environment or chemical industrial engineer qualification or higher are required. Entry-level or higher construction engineers in the same field are recognized, but water personnel only if their specialty is water quality management, and one person with several qualifications counts as one.

    Arrange facilities, equipment and measurement agency contracts: An office and laboratory, test equipment for 6 items (BOD, COD, suspended solids, total nitrogen and total phosphorus, coliform count, chloride ion concentration), and drafting equipment or a CAD computer are needed. With a measurement agency contract for an item, the equipment for that item is not required, and with a contract for all items, the laboratory is not required either; leased equipment is also accepted.

    Prepare and submit the registration application: The registration application (Form No. 29 of the Enforcement Rule of the Sewerage Act) is filed with the city, county or district office having jurisdiction over the office location, together with the statement of facilities and equipment (including a copy of any measurement agency contract) and the list of technical personnel with proof of qualifications. The processing period is 10 days, and if there are no disqualifications and the registration standards are met, a registration certificate (Form No. 30) is issued.

    Receive the certificate and confirm compliance duties: The registration certificate must be posted in the office, contracted work must be designed directly, and neither design subcontracting nor subcontracting of the entire work is allowed. If the trade name, technical personnel, representative, office location or laboratory location (including changes to the measurement agency contract) changes, a change report is filed on the same form within 30 days of the change.

If a technical staff member leaves or a measurement agency contract ends and no change report is filed within 30 days, fines for negligence and administrative sanctions may follow, so change report documents should be prepared as soon as personnel or contracts change.
