Public Interest Corporation (Designated Donation Organization) Designation Application

For a nonprofit corporation licensed under Article 32 of the Civil Act, a nonprofit foreign corporation, a social cooperative or a similar body to become an organization eligible for donation deductions, it must be designated and announced as a public interest corporation by the Minister of Finance and Economy upon recommendation by the Commissioner of the National Tax Service (including the head of the tax office with jurisdiction over the main office) under Article 39 of the Enforcement Decree of the Corporate Tax Act. Designation is made each quarter, and the recommendation application must be filed by the 10th day of the month two months before the last month of the quarter, so the deadlines are January 10, April 10, July 10 and October 10. The articles of incorporation must state that income is used for the public interest with unspecified beneficiaries, that residual assets go to the state, a local government or similar bodies on dissolution, and that donations raised and their use are disclosed on the website, and the corporation's website must be linked to the reporting website of an agency that oversees public interest violations. The designation period is 3 years from January 1 of the year of designation, or 6 years if redesignated within 2 years after it ends, and designation is not possible within 3 years of revocation or if election campaigning was carried out in the name of the corporation or its representative in the designation year or the previous year.

Procedure

Procedure

  1. 01

Check eligibility and disqualifications: Eligible applicants include nonprofit corporations under the Civil Act, nonprofit foreign corporations, social cooperatives, and public institutions other than public enterprises. Designation is not possible within 3 years of revocation, or if campaigning for a specific party or person was carried out in the name of the corporation or its representative in the designation year or the previous year.

  2. 02

Revise the required articles: Include provisions that income is used for the public interest rather than for members and that direct beneficiaries are unspecified, that residual assets are transferred on dissolution, and that annual donations raised and their use are disclosed on the website. If the articles are amended, obtain the supervising authority's approval first.

  3. 03

Open a website and link a reporting channel: Open the corporation's website and link it to the reporting website of at least one oversight agency for public interest violations, such as the Anti-Corruption and Civil Rights Commission, the National Tax Service or the supervising authority. Without this link the requirements are not met even if the articles are in order.

  4. 04

Prepare the recommendation application and attachments: Attach the establishment permit, articles of incorporation, financial statements for the last 3 years and the budget for the current year, a donation fundraising business plan for the designation period, and the representative's compliance pledge. A corporation less than 3 years old submits the available financial statements, the budget and monthly income and expense statements up to the month before application.

  5. 05

Submit by the quarterly deadline: File with the Commissioner of the National Tax Service or the head of the tax office with jurisdiction over the main office by the 10th day of the month two months before the last month of the quarter. The Commissioner recommends qualifying corporations to the Minister of Finance and Economy by the 10th day of the month before the last month of the quarter, and designations are announced.

  6. 06

Prepare for redesignation: Designation is not renewed automatically, so a new recommendation application must be filed after the period ends. If redesignated within 2 years after the period ends so that the period becomes 6 years, a public interest activity report on donation fundraising and spending is submitted instead of the pledge.

Missing the fourth-quarter deadline of October 10 pushes designation to the first quarter of the next year, so the designation period starts on January 1 of the next year and donations received that year are not deductible.
