Confirmation as a Materials, Parts and Equipment Specialized Company

A company whose main business is developing or manufacturing materials, parts or equipment may apply for confirmation as a specialized company under Article 14 of the Special Measures Act on Strengthening the Competitiveness of the Materials, Parts and Equipment Industry and Stabilizing Supply Chains, and the Korea Evaluation Institute of Industrial Technology handles confirmation under Article 82 of the Enforcement Decree. Materials, parts and equipment sales must account for 50% or more of total sales in the previous year, and a company belonging to a business group subject to limitations on cross-shareholding must keep sales to its own affiliates below 50% of its materials, parts and equipment sales. Only products falling under the Korean Standard Industrial Classification numbers in Annex 1 of the Enforcement Rule count toward these sales, and there is no application fee. The confirmation is valid for 3 years and is revoked if obtained by false or fraudulent means.

    Check product scope: For each product, confirm whether it falls under a Korean Standard Industrial Classification number listed in Annex 1 of the Enforcement Rule, and organize the product name, industrial classification code and HS code to enter on the application. Sales of products not listed in Annex 1 cannot be counted as materials, parts and equipment sales.

    Calculate the previous year's sales ratio: Total sales are calculated under Article 7 of the Enforcement Decree of the Framework Act on Small and Medium Enterprises, and you check whether materials, parts and equipment sales (domestic sales and exports) are 50% or more of the total. Companies in a cross-shareholding restricted group also check that sales to their own affiliates are below 50%.

    Prepare attachments: Gather documents proving materials, parts and equipment sales and a sales review opinion prepared by a person qualified under Article 4(1)2 of the Enforcement Rule. Attach an audit report if the corporation is subject to external audit, or financial statements under Article 447 of the Commercial Act otherwise, and align all documents to the same fiscal year.

    Prepare and submit the application: Submit the specialized company confirmation application with the sales breakdown and attachments to the Korea Evaluation Institute of Industrial Technology. There is no application fee, and any supplementary materials requested after submission are prepared with evidence from the same reference year.

    Respond to document and on-site reviews: The receiving institution may conduct a document review or on-site inspection, and notifies the date, purpose and place at least 3 days before an on-site inspection. If the sales breakdown does not match the evidence, additional materials are requested, so prepare a product-by-product sales summary in advance.

  6. 06

    Issuance and follow-up: If the requirements are met, a specialized company confirmation valid for 3 years is issued. Reviews of continued compliance may take place during the validity period, and the confirmation may be revoked after hearing the company's opinion if it no longer meets the requirements or cannot continue business due to default, closure or suspension.
