Procedure
- 01
Check the notice and deadlines: From the notice received from the school or district office of education, confirm the reported conduct, the hearing date of the Regional Teacher Rights Protection Committee, and how and by when an opinion can be submitted. If a measure has already been notified, calculate the appeal deadline as a calendar date from the day of receipt.
- 02
Match the type of infringement: Determine whether the reported conduct falls under the criminal-act types in Article 19 of the same Act or under undue interference types such as repeatedly filing complaints without a legitimate purpose or persistently forcing a teacher to do things that are not legal duties, and decide the issues the opinion must address.
- 03
Organize the facts: Arrange the dates, frequency and method of complaints, text messages, emails, call records and meeting notes in chronological order, and mark any points that differ from the report together with materials that show the facts.
- 04
Prepare and submit the parent's opinion: Prepare a written opinion focused on dates and evidence covering the background, the purpose and circumstances of the conduct, efforts to restore the relationship with the teacher and a plan to prevent recurrence, and submit it to the district office of education before the hearing date. In case the parent attends the committee to make a statement, summarize the key points consistently with the written opinion.
- 05
Review the superintendent's measure: The superintendent of the district office takes the measure within 14 days of the committee's request. Check the measure, the institution and deadline for special education or psychological treatment and the appeal information in the notice, and note that refusing special education or psychological treatment without a justifiable reason is subject to a fine for negligence of up to 3,000,000 won.
- 06
Prepare and submit the appeal petition and application for suspension: If the parent disputes the measure, prepare a petition to the administrative appeals commission under the provincial/metropolitan superintendent of education within 90 days of learning of the disposition and submit it to the superintendent of the district office or the commission. If the deadline for carrying out the measure is near, also prepare and submit an application for suspension of execution.

Filing an administrative appeal does not stop the effect or execution of the measure (Article 30(1) of the Administrative Appeals Act), so if the deadline for completing special education is near, the petition and the application for suspension of execution should be filed together to avoid the fine for negligence.
