Temporary Building Construction Report and Permit (Including Extension of Retention Period)

Under Article 20 of the Building Act, temporary buildings follow either a permit procedure or a construction report procedure depending on their location and use. A temporary building on an urban or Gun planning facility site, or a planned site for such a facility, requires a permit from the Special Self-Governing City Mayor, Special Self-Governing Province Governor, or the head of the Si, Gun or Gu, and the head of the Si, Gun or Gu does not grant a permit for temporary buildings of four or more stories or of reinforced concrete construction, among others. Uses listed in Article 15(5) of the Enforcement Decree, such as temporary buildings for construction work and container-type temporary offices, warehouses and lodgings, may be started after filing a construction report with the Si, Gun or Gu, and the retention period for reported buildings is within 3 years (until completion of the work for construction-use buildings). An owner who wishes to extend the retention period must file an extension report at least 7 days before expiry for reported buildings, or apply for an extension permit at least 14 days before expiry for permitted buildings, and the number of extensions is limited to the range set by the local building ordinance.

Procedure

Procedure

  1. 01

Determine permit or report: Check through the land use plan whether the site is an urban or Gun planning facility or a planned site for one; if not, compare the intended use against the reportable uses in Article 15(5) of the Enforcement Decree, such as construction use, container-type temporary offices, warehouses and lodgings, and outdoor smoking rooms of 50㎡ or less in total floor area. Containers placed on the rooftop of a building are excluded from the reportable uses.

  2. 02

Confirm land use rights and site restrictions: If the landowner differs from the applicant, obtain a letter of consent for land use; for common areas of an aggregate building, check whether proof of a management body resolution can substitute. Because the Si, Gun or Gu consults relevant agencies on restrictions under other laws, site restrictions such as farmland, mountainous land or development restriction zones are checked in advance.

  3. 03

Prepare the report or permit application: For reportable buildings, enter the use, structure, area and retention period in the Temporary Building Construction Report (Form No. 8) and attach the site plan and floor plan. For permitted buildings, enter the retention period in the temporary building section of the building permit application (Form No. 1-4). If the details of a construction-use temporary building were submitted together with a building permit application, a separate construction report is not required.

  4. 04

Check safety documents for three or more stories: For a temporary building of three or more stories to be exempted from structural and evacuation provisions, its safety must be recognized by the local building committee review; the review may be omitted by submitting elevation, section and structural drawings, structural calculations, a structural safety and seismic design confirmation, and an evacuation safety confirmation. These documents are prepared by the designer and attached.

  5. 05

Submit via Seumteo and receive the certificate: Submit through Seumteo online filing or to the building department of the Si, Gun or Gu. When the Si, Gun or Gu requests consultation from a relevant agency, that agency must give its opinion within 15 days, and if no opinion is given within that period, consultation is deemed complete. Once accepted, a temporary building construction report certificate (a permit for permitted buildings) is issued and the building is entered in the temporary building register, after which construction may begin.

  6. 06

Extend before the retention period expires: The Si, Gun or Gu notifies the owner of the expiry date and whether extension is possible at least 30 days before expiry. For reported buildings, file the Retention Period Extension Report (Form No. 11) at least 7 days before expiry with front, rear and both side photos taken within 1 month before the filing date; for permitted buildings, apply for an extension permit at least 14 days before expiry. Temporary buildings installed in factories, among others, are deemed extended for the same period unless the owner gives notice that extension is not wanted.

Installing a reportable temporary building before filing the report is subject to a fine of up to 50 million won under Article 111 of the Building Act, and building a permit-required temporary building without a permit is subject to up to 2 years of imprisonment or a fine of up to 100 million won under Article 110, so the permit or report classification and filing should be completed before construction begins.
