Tourist Accommodation (Hotel Business) Business Plan Approval and Registration

Hotel businesses such as tourist hotels, family hotels, hostels and small hotels must, under Article 15 of the Tourism Promotion Act, prepare a business plan and obtain approval from the head of the special self-governing city or province, city, county or district before tourism business registration; the processing period stated on the forms is 12 days for both approval and change approval. Article 13 of the Enforcement Decree sets the approval standards: the plan must comply with the relevant laws and the applicant must have the ability and means to finance the project, and in general residential areas additional standards on road frontage, building height and landscaping apply. Once the facilities are built according to the approved plan, the registration application is reviewed by the city, county or district registration deliberation committee (Article 17 of the Act) and a registration certificate is issued, with a processing period of 7 days on the form. Under Appended Table 1 of the Enforcement Decree, a family hotel needs at least 30 rooms of 19㎡ or more each, and a small hotel needs at least 20 and fewer than 30 rooms.

Procedure

Procedure

  1. 01

Match the hotel type to the registration standards: Under Appended Table 1 of the Enforcement Decree, a family hotel needs at least 30 rooms with a bathroom or shower, each room at least 19㎡, and cooking facilities in each room or a shared kitchen on each floor. A small hotel needs at least 20 and fewer than 30 rooms plus two or more types of ancillary facilities (total area no more than 50% of the gross floor area), and a hostel needs toilets, showers and kitchens that may be shared, and a cultural and information exchange space.

  2. 02

Check the site against the approval standards: In a general residential area, the site of a tourist hotel or family hotel must adjoin a road at least 12m wide, and a hostel or small hotel a road at least 8m wide, along at least 4m, and landscaping must cover at least 15% of the site area (except hostels). Cities, counties and districts may tighten these standards by ordinance, so check the local ordinance before signing for land or a building.

  3. 03

Apply for business plan approval: Submit the application (Enforcement Rule Form No. 25) to the city, county or district with a construction plan (location, land-use plan, construction schedule, construction funds and financing, floor area by facility and floor, bird's-eye view) and proof of ownership or right of use of the property. To have farmland conversion, mountain land conversion or development activity permits deemed granted, also submit the documents required by those laws; matters consulted with the competent agencies are treated as approved together.

  4. 04

Apply for change approval if the plan changes: To change the site or lot area or the gross floor area by 10% or more of the approved plan, or to switch the hotel type within the registration standards, submit a change approval application (Form No. 26) with a statement of reasons. If a change of building use is involved, attach before-and-after floor plans and drawings showing fire resistance, fire protection and evacuation; the approval is treated as a building use change permit or report under the Building Act.

  5. 05

Apply for tourism business registration and deliberation: When the facilities are ready, submit the tourism business registration application (Form No. 1) with the business plan, floor plans and site layout, the facility list for tourist accommodation (Form No. 2) and proof of permits for ancillary businesses. Matters reviewed by the registration deliberation committee are treated as lodging business reports, restaurant permits or reports, and liquor sales licenses or reports.

  6. 06

Apply for hotel grading after registration: Tourist hotels, family hotels, small hotels and similar types must apply to the grading agency for a desired grade within 60 days of hotel registration, and the agency decides and notifies the grade within 90 days of the application. Hostels are not subject to the grading application.

Buying land or starting use-change construction before business plan approval can leave the site short of the road frontage or landscaping standards, so approval and hotel registration become impossible; check the local ordinance before signing any contract.
