Waste Recycling Report (Waste Treatment Report)

A waste treatment report under Article 46 of the Wastes Control Act allows a business to recycle other people's waste by reporting rather than obtaining a permit. A site that sorts, compresses, reduces or cuts waste paper, scrap metal, packaging subject to recycling obligations, waste electric wire or disposable cups must report if the site is 1,000㎡ or more in a special or metropolitan city, or 2,000㎡ or more in a city or county (including counties of metropolitan cities), and recycling types listed in Annex 16 of the Enforcement Rule, such as composting and feed production, are also reported. The report must be filed with the city/province with jurisdiction over the site at least 15 days before waste treatment begins, and the city/province notifies acceptance within 20 days. Designated waste is excluded from this report, and a recycling business that produces intermediate processed waste requires an Article 25 permit, so first confirm whether the activity is subject to reporting.

Procedure

Procedure

  1. 01

Confirm reporting eligibility: Check the waste type, recycling method and site area against Article 66 and Annex 16 of the Enforcement Rule. Waste paper, scrap metal and similar items must be handled by sorting, compressing, reducing or cutting (stripping for waste wire), and if designated waste is mixed in or another method is used, review whether a recycling business permit is required.

  2. 02

Prepare storage and recycling facilities: Storage must hold at least 1 day and no more than 30 days of daily treatment capacity in containers or facilities, and recycling facilities must include the applicable sorting, compressing, reducing, cutting, feed or compost facility for the waste type and method. If you collect and transport the waste yourself, at least 1 vehicle is required.

  3. 03

Prepare the report and attachments: Attach to the waste recycling report (Form No. 56-2) the documents confirming eligibility, a description of the recycling use or method, a recycling facility specification, the storage capacity and its calculation basis, and a treatment plan for waste generated during recycling. Add a collection and transport plan if you transport the waste yourself.

  4. 04

File 15 days before starting and receive acceptance: File with the city/province for the site at least 15 days before waste treatment begins. The city/province notifies acceptance within 20 days and issues a report certificate if suitable; if no acceptance or extension notice is given within that period, the report is deemed accepted on the day after the period ends.

  5. 05

Measures against abandoned waste before operation: A reporter handling business waste must, before starting operation, pay contributions to the waste treatment mutual aid association or take out insurance guaranteeing waste treatment. Reporters specified in the Enforcement Rule in view of the risk of abandonment are exempt.

  6. 06

Change reports and compliance: To change the trade name or site location, the type of waste recycled, the recycling use or method, the type of recycling facility, the storage capacity, or the number of transport vehicles, file a change report with the report certificate before making the change. Recycling facility capacity requires a change report when cumulative changes after the report reach 30% or more.

If a facility closure order is issued for failing to follow the compliance requirements, a new waste treatment report cannot be filed for 1 year from the order, so manage requirements such as the permitted storage volume and retention of consignment contracts from the start of operation.
