Construction Business Registration Requirements and Documents — Capital, Technical Personnel and the Confirmation of Guaranteeable Amount

Procedure

1. 1. Check whether the work requires registration

   Work can be performed without registration if the estimated construction amount of 1 project is less than 50,000,000 won for general construction work or less than 15,000,000 won for specialized construction work. However, gas facility, steel structure, cableway, elevator, railway and track, and heating works require registration regardless of the amount. Even if the work is split into separate contracts, it is judged by the combined amount.

2. 2. Check the business type and the registration standards

   The technical capability and capital standards differ for each business type. For example, the building construction business requires corporate capital of 350,000,000 won or more and 5 construction engineers of beginner grade or higher in the building field (including 2 who hold an Engineer (gisa) certificate or are of intermediate grade or higher), and the civil engineering construction business requires 500,000,000 won or more for a corporation and 6 persons in the civil engineering field. For the earthwork field of the ground formation and paving work business, which is specialized construction work, the standards are 2 or more technical personnel and capital of 150,000,000 won or more.

3. 3. Obtain the confirmation of guaranteeable amount

   Obtain, from a designated financial institution or similar body, a confirmation of guaranteeable amount stating that a guarantee of at least the capital standard is possible. Depending on its financial and credit assessment, the issuing institution requires collateral or a cash deposit in the range of 25% to 60% of the capital for the business type.

4. 4. Secure the office and technical personnel

   The office must be in a building that has received approval for use and must meet the location standards in the public notice of the Ministry of Land, Infrastructure and Transport. Whether you actually have the technical personnel is checked through their employment insurance and industrial accident compensation insurance enrollment records, so they must in fact be employed by you.

5. 5. Apply for registration

   Submit the construction business registration application to the receiving body, attaching the statement of financial position (for an individual, the statement of business asset amounts), the confirmation of guaranteeable amount, the office lease contract and the status of technical personnel. General construction work and the specialized construction work publicly notified by the Ministry of Land, Infrastructure and Transport are received by the entrusted institution, and other specialized construction work is by law received by the Si/Do (metropolitan city or provincial) government, but some Si/Do governments have re-delegated this task to Si/Gun/Gu offices by their own rules. Incheon Metropolitan City re-delegates the receipt of registrations for specialized construction businesses to the district heads under its delegation rule, so applications are received at the district office (gu-cheong) where the office is located. Check the receiving office with the local construction department before applying. Attachments must have been issued within 1 month before the submission date.

• Confirmation of guaranteeable amount
• Proof of office (an owned office is checked in the register; for a leased office, a copy of the lease contract)
• Status of technical personnel (qualification certificates and career records, confirmation of employment insurance and industrial accident compensation insurance enrollment)
• Status of facilities and equipment (applicable business types only)
• Foreigners and foreign corporations: documents confirming that there are no grounds for disqualification (with an apostille or consular confirmation)

Fees

Fees in the industry range from several hundred thousand won to several million won.
