Construction Machinery Transfer Registration and Change of Registered Details — Checking Document Mismatches That Lead to Rejection

Construction machinery such as excavators, forklifts, dump trucks, loaders and cranes is registered with the registration office under Article 3 of the Construction Machinery Management Act. If the owner changes, or the trade name, head office, representative or principal place of use changes, a report of change in registered details must be filed within 30 days (6 months for inheritance) from the date of the change. A transfer of title by sale (commonly called transfer registration) is handled as a report of change with a transfer certificate attached. The filing is refused if even a single digit of the chassis number on the transfer certificate differs, so first check that the documents match.

Procedure

  1. 1. Check the rights in the registration ledger

Check in the construction machinery registration ledger whether a mortgage or seizure has been registered. Machinery with such an encumbrance, or machinery in the name of a business that has closed, can be transferred only after the rights are settled.

  2. 2. Check that the documents match

Check that the chassis number and the registration number on the transfer certificate do not differ from the registration ledger by even a single digit. A difference between the business registration address and the actual principal place of use is also a ground for rejection.

  3. 3. Check documents according to commercial or private use

For commercial-use construction machinery, unlike private-use machinery, documents related to the rental business are also reviewed. If you do not have the documents that fit the use, you will be asked to supplement them.

  4. 4. File with the registration office

Submit the Report of Change in Construction Machinery Registration Details (with the transfer certificate attached for a sale) to the competent registration office. Also check that payment of acquisition tax and the purchase of bonds have not been left out.

Required documents

  • Report of Change in Construction Machinery Registration Details (a transfer of title by sale is also handled with this form)
  • Transfer certificate (check that the chassis number and registration number match)
  • Construction machinery registration certificate
  • Identification or business verification documents of the transferor and the transferee
  • Proof of the principal place of use
  • Confirmation of acquisition tax payment and proof of bond purchase
  • For commercial use: documents related to the rental business

Fees

Acquisition tax, bonds and registration fees are separate and depend on the machinery and the jurisdiction. In the market, agency fees generally range from tens of thousands to several hundred thousand won per case, and vary when rights need to be settled, such as clearing a mortgage or seizure or conversion to a corporation. We will review the registration ledger and advise you on the fee after a consultation.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Compare the chassis number on the transfer certificate with the registration ledger digit by digit.
  • If registered details change, a report of change must be filed within 30 days (6 months for inheritance).

Frequently asked questions

Do excavators and forklifts also need a transfer of title?
Yes. For machinery subject to registration under the Construction Machinery Management Act, such as excavators, forklifts and dump trucks, when the owner changes, a report of change in registered details must be filed with a transfer certificate attached within 30 days (6 months for inheritance) from the date of the change. In practice this is commonly called transfer registration.
Why is a construction machinery transfer registration rejected?
The filing is refused if even a single digit of the chassis number on the transfer certificate differs. A difference between the business registration address and the actual principal place of use is also a common ground for rejection.
Can construction machinery with a mortgage be transferred?
For machinery with a registered mortgage or seizure, the rights must be cleared first. After checking the details in the registration ledger, decide whether the encumbrance will be cancelled or assumed.
Do I have to report even if only the company address changes?
If the trade name, head office, representative or principal place of use changes, a report of change in registered details under Article 5 of the Construction Machinery Management Act must be filed within 30 days from the date of the change.
