Food Subdivision Business Report: Procedure and Facility Standards — Items Prohibited from Subdivision and Labeling

To divide bulk food into smaller portions, repackage it and sell it, you must file a food subdivision business report under the Food Sanitation Act. The facility standards for workplaces of the food manufacturing and processing business apply to the subdivision room, so unlike an ordinary shop a separate work space is required, and some items may not be subdivided. A business report certificate is issued when you report, and where the facilities need to be verified, the official in charge checks the site within 15 days after issuance.

Procedure

  1. 1. Checking the items to be subdivided

First check whether the food you plan to subdivide is an item that may be subdivided. Some items, such as canned and bottled products and retort foods, are prohibited from subdivision, so if you start facility construction before fixing the list of items, you may have to redo it.

  2. 2. Setting up the subdivision room and storage facilities

The standards for workplaces of the food manufacturing and processing business apply to the subdivision room. Install subdivision and packaging facilities, storage facilities for raw materials and finished products, and washing and disinfection facilities, and separate the clean zone from the general zone. If tap water is not used, the water supply facility must meet the drinking water quality standards.

  3. 3. Completing sanitation education

A new business operator must receive food sanitation education before filing the business report. The method and hours of education are set by type of business, so check at the time of application.

  4. 4. Business report and on-site verification

Submit the business report form and attachments to the city, county or district (si/gun/gu) office having jurisdiction over the place of business. The business report certificate is issued without delay. Where the facilities need to be verified, the official in charge checks the site within 15 days after issuance, and if the standards are not met, you are inspected again after making corrections.

  5. 5. Selling with the required labeling

Subdivided products must be labeled with the product name, ingredients, use-by date, storage method, information on the subdivision business, allergens and other items. Regular inspections continue after opening, so keep up the subdivision records and labeling management.

Frequently asked questions

Is the food subdivision business subject to a permit or a report?
It is subject to a business report under the Food Sanitation Act. When you report to the competent city, county or district (si/gun/gu) office, a business report certificate is issued, and where the facilities need to be verified, an on-site check takes place within 15 days after issuance. Subdividing and selling without a report is subject to administrative dispositions and punishment.
Can every food be subdivided and sold?
No. Some items, such as canned and bottled products and retort foods, are prohibited from subdivision. The proper order is to fix the list of items to be subdivided first and check whether each is allowed.
Can subdivision work be done in one corner of the shop?
The standards for workplaces of the food manufacturing and processing business apply to the subdivision room, so a work space partitioned from the sales area is required. Washing and disinfection facilities and storage facilities for raw materials and finished products are also required.
What must be shown on the label of subdivided products?
The product name, names of ingredients, use-by date, storage method, information on the subdivision business, allergens and other items. The labeling must be managed so that it does not differ from that of the original product.
Can an administrative agent file the food subdivision business report on my behalf?
Yes. Hwang Yunsang Administrative Office reviews the items to be subdivided and the partitioning of the place of business, prepares the business report form and attachments such as the floor plan, and files the report on your behalf. The sanitation education must be completed by the business operator himself or herself.
