Industrial Accident Insurance Benefit Claim — From the Medical Care Benefit Application to the 90-Day Review Request
A worker injured in a work-related accident applies for medical care benefits with the Korea Workers' Compensation and Welfare Service. The application states the workplace, how the accident occurred and medical opinions (Industrial Accident Compensation Insurance Act, Article 41(1)), and the Service must decide and notify within 7 days of receipt (Enforcement Rules, Article 21(1)). Time for committee deliberation, investigation and document supplementation is not counted in the 7 days. A decision can be challenged by a review request to the Service within 90 days of learning of the decision (Article 103(3)), and a further re-review request within 90 days of learning of the review decision (Article 106(3)). The right to insurance benefits lapses after 3 years (5 years for disability benefits, survivor benefits, funeral expenses and similar) (Article 112).
Procedure
- Application Difficulty Medium
An application for a subsidy, benefit, compensation or decision. The authority reviews whether the payment or selection criteria are met and then decides.
- Appeal Difficulty High
Submitting an opinion, objection or administrative appeal against a disposition or decision already made, or applying for damage relief or dispute mediation. The reviewing body decides after examining the facts and the law, so preparing supporting evidence is important.
1. Identify the benefit types and which to claim
Insurance benefits include medical care, temporary incapacity, disability, caregiving, survivor, injury and disease compensation annuity, funeral expenses and vocational rehabilitation benefits, paid on the claim of the eligible person (Article 36). Based on how the accident occurred and the treatment status, decide which benefit to claim first.
2. Prepare the accident circumstances and medical opinion materials
A medical care benefit application needs documents stating the workplace, how the accident occurred and the medical opinion on it (Article 41(1)). Arrange the accident report, medical certificate or opinion, and workplace information in chronological order, and include coworker statements or site materials if available.
3. Prepare and submit the medical care benefit application
The worker may apply to the Service directly, or an industrial accident insurance medical institution may file on the worker's behalf with consent (Article 41(2), Enforcement Rules, Article 20(1)). The Service informs the employer and hears their opinion (Enforcement Rules, Article 20(2)).
4. Check the Service's decision
The Service decides whether to pay within 7 days of receiving the application and notifies the applicant and the insured employer (Enforcement Rules, Article 21(1)). Time for committee deliberation, investigation, document supplementation and hearing the employer's opinion is not counted, so the decision may take longer (paragraph 2).
5. If denied, file a review request and re-review request
To challenge a benefit decision, file a review request with the Service through its branch that made the decision within 90 days of learning of the decision (Article 103(2) and (3)). The Service decides within 60 days of receiving the review request and may extend once by up to 20 days (Article 105(1)). If you disagree with that decision, file a re-review request within 90 days of learning of the decision (Article 106(3)).
