KCs Self-Safety Confirmation Report — Filing Form and Attachments Before Shipping Grinders, Conveyors and Industrial Robots
Anyone who manufactures or imports machinery listed in Article 77 of the Enforcement Decree of the Occupational Safety and Health Act, such as grinders, industrial robots, mixers and conveyors, must confirm that it meets the self-safety standards and report it to the Korea Occupational Safety and Health Agency before shipping or importing. The Agency issues a self-safety confirmation report certificate within 15 days of receiving the report, and the reporter must place the self-safety confirmation mark on the product or packaging. Presses, cranes and other machinery subject to mandatory safety certification under Article 84 of the same Act follow a separate procedure, so the applicable category is checked first.
Procedure
1. Check whether the machinery is covered
Article 77(1) of the Enforcement Decree covers grinders and polishers (excluding portable types), industrial robots, mixers, crushers and pulverizers, food processing machines (crushing, cutting, mixing and noodle-making only), conveyors, vehicle maintenance lifts, machine tools, stationary woodworking machines, printing machines, and certain protective devices and protective equipment. Detailed types, specifications and models are set by Ministry of Employment and Labor notice, so the actual structure and function are compared rather than the product name. Items listed in Article 74, such as presses, cranes, lifts, pressure vessels and injection molding machines, require safety certification instead.
2. Review exemption grounds
The report may be exempted for manufacture or import for research and development, manufacture for export, or products that have received safety certification under Article 84(3) (proviso to Article 89(1)). Article 119 of the Enforcement Rule also lists inspection under the Agricultural Mechanization Promotion Act, certification under the Industrial Standardization Act (KS), safety certification or safety inspection under the Electrical Appliances and Consumer Products Safety Control Act, and IECEx certification. Where such a certificate exists, its scope is checked against the product model before filing.
3. Prepare the product manual and conformity documents
The report form is accompanied by the product manual and documents proving that the machinery meets the self-safety standards (Article 120(1) of the Enforcement Rule). For imported machinery, drawings, specifications and protective device data from the overseas manufacturer are needed to compare each standard item, so the scope of technical data is agreed at the import contract stage. The model, capacity and manufacturer location are entered on the form as they are, so they must match the product actually shipped.
4. Complete the report form and file it with the Agency
The self-safety confirmation report (Form No. 48 of the Enforcement Rule) states the workplace details, the machinery name (domestic or imported), model, capacity and manufacturer, and is filed with the Korea Occupational Safety and Health Agency before shipping or importing, including electronic filing. The Agency checks the corporate register or business registration certificate through shared administrative information, and an individual who does not consent attaches the business registration certificate. The Agency issues the report certificate (Form No. 49) within 15 days of receipt.
5. Marking, record keeping and change reports
The reporter must place the self-safety confirmation mark under Annex 14 of the Enforcement Rule on the product, container or packaging, and keep documents proving conformity with the self-safety standards (Articles 89(3) and 90(1) of the Act). Changes to reported matters are also subject to reporting, so a change in model or structure is reported again.
Required documents
- Self-safety confirmation report (Form No. 48 of the Enforcement Rule of the Occupational Safety and Health Act)
- Product manual
- Documents proving that the machinery meets the self-safety standards
- For imported products: technical data such as the overseas manufacturer's drawings, specifications and protective device data needed for comparison with the standards
- Business registration certificate for individuals who do not consent to shared administrative information (the Agency checks the corporate register for corporations)
- Where an exemption is reviewed: the relevant certificate, such as a safety certificate, KS certificate, electrical appliance safety certificate or agricultural machinery inspection certificate
Fees
Industry range of tens of thousands to hundreds of thousands of won · Depending on the number of items and models, the work needed to organize technical data for imported products, and whether exemption grounds must be reviewed, we will advise after consultation. - Unreported machinery must not bear the self-safety confirmation mark or a similar mark or be advertised as confirmed (Article 90(2)), and failing to place the mark after reporting is subject to a fine for negligence of up to 5,000,000 won (Article 175(5)).
