Opening a Kids Cafe in Korea — Other Theme Park Business Report (Formerly Other Amusement Facility Business) and Rest Restaurant Report

A kids cafe that lets customers use play equipment runs a theme park business under the Tourism Promotion Act. An amendment in February 2024 renamed the amusement facility business to the theme park business, so the former Other Amusement Facility Business is now called the Other Theme Park Business. If all play facilities are outside the safety inspection list, the operator files an Other Theme Park Business report with the city, county or district office; if even one ride requires a safety inspection, a General Theme Park Business permit is needed instead. Preparing and selling drinks or snacks requires a separate Rest Restaurant business report under the Food Sanitation Act. A kids cafe is also a multi-use business, so fire safety facility standards apply as well.

Procedure

  1. 1. Check whether the play facilities require a safety inspection

Trampolines, mini adventure play structures (including play spaces) with a riding height of 3 m or less and an installed area of 120 m² or less, mini air bounces of the same limits, and mini slides 10 m or shorter with a riding height of 2 m or less are not subject to the safety inspection. If you install only such facilities, you file an Other Theme Park Business report. Adventure play structures or air bounces above these limits, or rides such as bumper cars, require a General Theme Park Business permit, so sort the equipment by its specification sheets first.

  2. 2. Meet the floor area and facility standards

An indoor Other Theme Park Business needs a building floor area of at least 40 m², at least one theme park facility not subject to the safety inspection, and a first-aid kit. The indoor business premises must be a separate building or be separated, partitioned or distinguished from facilities used for other purposes. If you also run a youth game provision business or internet computer game facility business in the same space, its area must be less than 50% of the reported area.

  3. 3. Prepare the confirmation inspection, insurance and safety management plan

Before filing, obtain an inspection from a designated inspection body confirming that the facilities are not subject to the safety inspection, and receive the inspection report. Also prepare proof of insurance or mutual aid coverage and a safety management plan covering safety checks, emergency contacts, emergency response and periodic replacement of key parts. If the premises are leased, attach a copy of the lease agreement.

  4. 4. File the Other Theme Park Business report with the city, county or district office

Submit the Other Theme Park Business report form with an outline of business facilities and equipment and the documents above to the mayor, county head or district head. The corporate register, resident registration abstract, building register and land use plan certificate are checked by the official through shared administrative information. Once the report is accepted, a theme park business report certificate is issued; if you plan to operate for less than 6 months, state that period on the form.

  5. 5. Rest Restaurant business report and multi-use business safety facilities

To prepare and sell drinks or snacks, complete 6 hours of food hygiene training in advance, install the required facilities, and submit a Rest Restaurant business report to the city, county or district office. If children's play facilities are installed on the premises, attach the installation inspection certificate or periodic inspection certificate for children's play facilities. Because a kids cafe is a multi-use business, report the design documents to the fire station before installing safety facilities and obtain a certificate of completion of safety facilities once the work is finished.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • After filing, if you add or remove play facilities, or the floor area, location, representative or business name changes, you must file a change report for the Other Theme Park Business within 30 days from the date the change occurs. Failing to file the change report can lead to a business suspension of up to 6 months or an order to improve facilities or operations.
  • Installing a ride subject to the safety inspection under only an Other Theme Park Business report amounts to operating a theme park business without a permit, which can lead to imprisonment of up to 3 years or a fine of up to 30,000,000 won. When replacing equipment, check its specifications and inspection category first.

Frequently asked questions

Does a kids cafe have to file an Other Theme Park Business report?
Yes, if it provides play equipment for customers to use. If all play facilities are outside the safety inspection list, the business must file an Other Theme Park Business report, and operating without it can lead to imprisonment of up to 1 year or a fine of up to 10,000,000 won. A shop that only sells drinks and snacks without play equipment needs to consider only the Rest Restaurant business report.
Are the Other Amusement Facility Business and the Other Theme Park Business different?
No, they are the same business type. The February 2024 amendment to the Tourism Promotion Act renamed the amusement facility business to the theme park business, so what used to be an Other Amusement Facility Business report is now filed on the Other Theme Park Business report form. Some laws and guidance materials still use the old name.
We only sell drinks. Do we still need a Rest Restaurant business report?
Yes, if you prepare and sell beverages or snacks. The Rest Restaurant business report is separate from the Other Theme Park Business report, and 6 hours of in-person food hygiene training must be completed before filing. The city, county or district office must notify you whether the report is accepted within 3 days.
Does an Other Theme Park Business need a safety manager?
The duty to assign a safety manager applies to comprehensive and general theme park businesses that operate facilities subject to the safety inspection. Instead, an Other Theme Park Business operator must check each facility at least once a day and keep the log for at least 1 year, train staff at least once a month, and give new hires at least 2 hours of safety training before they start. Facilities such as trampolines, mini air bounces and mini slides require a periodic confirmation inspection every 2 years, and their operators must take at least 4 hours of safety training every 2 years.
Can an administrative agent handle the kids cafe reports?
Yes. Hwang Yunsang Administrative Office reviews whether the play facilities are subject to the safety inspection and whether the floor area standard is met, prepares the Other Theme Park Business report, the outline of business facilities and equipment and the safety management plan, organizes the supporting documents and submits them to the city, county or district office, prepares and submits the Rest Restaurant business report, and prepares change reports.
