Logistics Warehouse Business Registration Requirements and Documents — The 1,000㎡ Floor Area Threshold and the Fire Safety Management Plan
Storing cargo in a logistics warehouse for a fee at the request of cargo owners, or loading, unloading, sorting, packing or labeling it, is a logistics warehouse business. You must register if the total floor area of the storage facilities you use directly is 1,000㎡ or more, or if the total area of storage yards is 4,500㎡ or more, and the application must include a business operation plan that contains a fire safety management plan. Under the application form, the processing period is 14 days and the fee is 10,000 won, and warehouses inside the port area of a state-managed trade port such as Incheon Port or Gyeongin Port are registered with the Regional Office of Oceans and Fisheries.
Procedure
1. Check whether the floor area triggers registration
For storage facilities, only the floor area you use directly is counted on a per-parcel basis, and adjoining parcels are added together to see whether the total reaches 1,000㎡. Storage yards are calculated the same way, including the land occupied by storage facilities, against the 4,500㎡ threshold. The floor area threshold does not apply to an order-delivery facility installed as a Class II neighborhood living facility.
2. Check the registration standards and building use
You must have a legitimate right to use the warehouse, and the facility must allow cargo to be stacked. A storage facility must be classified as a warehouse facility or as an order-delivery facility within Class II neighborhood living facilities. An order-delivery facility must also secure parking spaces, have no other order-delivery facility on an adjoining parcel, not adjoin a child, senior or disabled person protection zone, and not be within a straight-line distance of 200m from the boundary of a kindergarten or elementary school.
3. Prepare the business operation plan and fire safety management plan
A new registration application must be accompanied by documents proving compliance with the registration standards and a business operation plan that includes a fire safety management plan. The content and format of the fire safety management plan follow the preparation guidelines issued as a Ministry of Land, Infrastructure and Transport notice. If the representative is a foreign national, a home-country document confirming that no grounds for disqualification apply must be submitted with an apostille or consular confirmation.
4. Apply to the competent authority
In general areas, the metropolitan city or province holds the registration authority, and where it has delegated that authority, you apply to the logistics warehouse department of the city, county or district. Port areas of state-managed trade ports fall under the Regional Office of Oceans and Fisheries, and port areas of locally managed trade ports and locally managed coastal ports fall under the mayor or governor of the metropolitan city or province. The corporate register, building and land registers and building ledger are checked by the official in charge, and a registration certificate is issued after review.
5. Change registration and fire safety management after registration
If the representative's name or trade name or the warehouse location changes, or the warehouse area increases or decreases by 10% or more, you must file a change registration within 30 days from the date the reason arose. After registration, you must review the validity and adequacy of the fire safety management plan by December 31 every year, prepare and keep it, and carry out what the plan states. If you acquire the business or merge, you file a business succession report.
