Logistics Warehouse Business Registration and Change Registration (Including Fire Safety Management Plan)

A logistics warehouse business stores cargo in a logistics warehouse for a fee at the request of shippers, or carries out loading and unloading, sorting, packing, labeling and similar work. Under Article 21-2 of the Act on the Development and Management of Logistics Facilities, registration is required when the total floor area of storage facilities used directly by the operator is 1,000 m² or more, or the total area of storage yards is 4,500 m² or more. The registration standards are set in Article 3 of the Rules on Registration of Logistics Warehouse Business: the applicant must have a legitimate right to use the warehouse, cargo must be able to be stacked there, and the building use of the storage facility must be a warehouse facility or an order delivery facility among Class 2 neighborhood living facilities. A business operation plan including a fire safety management plan is attached to the application, which is filed with the city or province (or the city, county or district where the authority has been delegated), or with the Regional Maritime Affairs and Port Office for port areas of state-managed trade ports and coastal ports. If the representative, trade name or location changes, or the warehouse area increases or decreases by 10% or more, change registration must be made within 30 days of the cause arising.

Procedure

Procedure

  1. 01

Calculating the registration threshold: Add up the floor area of storage facilities used directly by the applicant on a single-lot basis, combining adjoining lots, and check whether it reaches 1,000 m². Storage yards are calculated the same way, including the land occupied by storage facilities, to see whether they reach 4,500 m². If the entire warehouse is licensed or registered and used only as a bonded warehouse, a hazardous chemical storage business, or a food freezing and refrigeration business, it is deemed registered as a logistics warehouse business.

  2. 02

Checking building use and location standards: Confirm on the building register that the storage facility is designated as a warehouse facility. When registering as an order delivery facility within Class 2 neighborhood living facilities, parking spaces must be secured, there must be no other order delivery facility on an adjoining lot, the site must not adjoin a child, elderly or disabled protection zone, and it must not be within 200 m in a straight line from the boundary of a kindergarten or elementary school.

  3. 03

Preparing the business operation plan: Set out the stored items, loading, sorting and packing methods, warehouse layout, the area used directly on each lot, and staffing in the business operation plan. For a leased warehouse, prove the right of use with the lease agreement, and if the representative is a foreign national, prepare home-country documents confirming no grounds for disqualification with an apostille or consular confirmation.

  4. 04

Preparing the fire safety management plan: Prepare plans for fire prevention, response and preparedness following the items of the preparation guidelines notified by the Ministry of Land, Infrastructure and Transport, and include them in the business operation plan. After registration, the plan must be reviewed for validity and adequacy, rewritten and kept by December 31 every year, and its contents must be carried out, so it should be written in terms the warehouse staff can actually follow.

  5. 05

Application and change registration: When the logistics warehouse business registration and change registration application is filed with the competent authority, the official checks the corporate register, building and land registers and the building register, reviews the registration standards and grounds for disqualification, and issues a registration certificate. After registration, change registration is made within 30 days if the representative, trade name or location changes or the area increases or decreases by 10% or more, and a business succession report is filed when the business is acquired or merged.
