Road Works Permit for Non-Road Authorities: Procedure and Documents — Access Road and Sidewalk Works, Road Act Article 36 Permit and Completion Inspection

When an individual or company that is not the road management authority directly carries out construction that newly builds, widens, improves or repairs a road, such as widening an access road junction or improving a sidewalk while building or developing land, it must first obtain a road works permit from the road management authority under Road Act Article 36. You submit the road works permit application with a business plan and design documents. The statutory processing period is 15 days, and the fee is 1/1,000 of the construction cost (excluding land and compensation costs) or the amount set by local ordinance. Report the start of works within 5 days of commencement, and after completion obtain a completion inspection by attaching the completion report, design documents and cost settlement statement. Placing facilities on a road and using it requires an occupancy permit under Article 61, while construction that changes the road itself requires a works permit under Article 36.

Procedure

  1. 1. Decide whether you need a works permit or an occupancy permit

Under the Road Act, road works means construction that newly builds, widens, improves or repairs a road, and when anyone other than the road management authority carries out such works, a permit under Article 36 is required. Works that change the road itself, such as widening an access road junction or newly paving a sidewalk, fall under this permit, while installing structures or objects on a road to use it requires an occupancy permit under Article 61. Minor maintenance that does not affect the road structure, such as partially replenishing gravel, sand or soil, can be done without a permit.

  2. 2. Identify the road management authority and the permit standards

You apply to the road management authority of the road concerned: for a general national road in a dong area of a metropolitan city it is the metropolitan city mayor, and for other roads it is the administrative agency that designated the route. To obtain the permit, the works must meet road structure and facility standards, and the design speed, curve radius, road width, pavement section and pavement material must be equal to or higher than those of the existing road being connected. Safety facilities such as traffic lights, road signs and guardrails, as well as drainage and slope protection facilities, must also be properly planned.

  3. 3. Submit the permit application, business plan and design documents

On the road works permit application, state the road type and route, the type of works, the section and period of works, and the purpose and reason, then submit it to the road management authority with the business plan and design documents. The statutory processing period is 15 days, and once the permit is granted the road management authority publicly announces the section, period, purpose and other details of the works. If consultation with the road management authority is completed during a building permit or development activity permit, the Article 36 permit is deemed granted, so prepare the road works documents at that application stage.

  4. 4. Commencement report and bearing the construction cost

After obtaining the permit, submit a road works commencement report to the road management authority within 5 days of starting the works. The cost of road works by a non-road authority is borne by the party carrying out the works. If the works differ from the permit or the permit was obtained by false or improper means, the permit may be revoked or the works suspended.

  5. 5. Completion inspection and submission of the road ledger

When the works are finished, apply without delay for a completion inspection using the road works completion inspection application, attaching the completion report, design documents and cost settlement statement. If the works change the road ledger, the party carrying out the works must prepare the road ledger on behalf of the authority and submit it to the road management authority without delay after completion. Public facilities such as roads newly installed under a development activity permit (including a deemed permit) are transferred free of charge to the authority that will manage them.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • Even after obtaining the permit, you must report commencement within 5 days of starting and obtain a completion inspection after completion. Put the commencement report and completion inspection paperwork into the construction schedule in advance.
  • For works that change the road ledger, the party carrying out the works must prepare and submit the road ledger after completion, so organize as-built drawings and cost settlement records during construction.

Frequently asked questions

What is the difference between a road occupancy permit and a road works permit for non-road authorities?
They cover different acts. A road occupancy permit (Road Act Article 61) is required when you newly install or change structures or objects or otherwise occupy a road, and a road works permit for non-road authorities (Article 36) is required when you carry out works that newly build, widen, improve or repair the road itself. A single project may need both permits, so divide them based on the content of the works.
What are the processing period and fee for a road works permit for non-road authorities?
The statutory processing period is 15 days. The fee is 1/1,000 of the construction cost at the time of the permit (excluding land and compensation costs), and if the local government to which the road management authority belongs has set an amount by ordinance, that amount applies. The construction cost itself is borne by the party carrying out the works.
If I get a building permit, do I still need a separate road works permit?
Conditionally, no. Building Act Article 11(5)8 and National Land Planning and Utilization Act Article 61 deem the Road Act Article 36 permit granted when a building permit or development activity permit is granted. However, this applies only where the permitting authority consulted the road management authority in advance, and for a development activity permit the related documents must be submitted with the application, so prepare the road works documents from the start.
What happens if I build an access road without a permit?
It is subject to criminal penalties. Road Act Article 114 provides imprisonment of up to 2 years or a fine of up to 20,000,000 won for anyone who carries out road works without a permit in violation of Article 36(1). Under Article 96, the road management authority may also order dispositions or measures such as suspension of works, reconstruction of structures or relocation of objects.
Does an administrative agent handle the road works permit for non-road authorities?
Yes. Hwang Yunsang Administrative Office reviews whether a works permit is required and identifies the road management authority, prepares the road works permit application and business plan, organizes attachments such as design documents and submits them to the road management authority on your behalf, and prepares and submits the road works commencement report and completion inspection application on your behalf.
