Road Works Permit for Non-Road Authorities (Access Road and Sidewalk Works, Commencement Report and Completion Inspection)

When an individual or company that is not the road authority directly carries out road works such as widening the junction of an access road or improving a sidewalk in connection with a building or development project, including the construction, expansion, improvement or repair of a road, it must obtain a road works permit from the road authority in advance under Article 36 of the Road Act. The application is filed with the road authority of the road to be worked on, with a business plan and design documents attached to the road works permit application, and the statutory processing period is 15 days. A permit holder must report commencement within 5 days of starting the works and, on completion, must undergo the road authority's completion inspection with a completion report, design documents and a cost settlement statement attached. Installing structures on a road and using it requires a road occupancy permit under Article 61, and connecting another passage to a road requires a connection permit under Article 52, so several permits may be needed depending on the works. Carrying out road works without a permit is punishable under Article 114 by imprisonment of up to 2 years or a fine of up to 20 million won.

Procedure

Procedure

  1. 01

Identifying the type of permit: Based on the works, distinguish between works that widen the road itself or change its pavement or structure (Article 36 works permit), installing structures or objects on the road (Article 61 occupancy permit), and connecting an access road to the road (Article 52 connection permit). Minor maintenance that does not affect the road structure, such as partly topping up gravel or soil, does not require a permit.

  2. 02

Checking the road authority and permit standards: The administrative agency that designated the route of the road is where the application is filed, and the metropolitan city mayor is responsible for general national roads in the dong areas of a metropolitan city. Design speed, curve radius, road width, pavement cross-section and pavement material must be equal to or better than the existing road being connected, and plans for safety facilities such as traffic lights, road signs and guardrails and for drainage facilities are part of the permit standards.

  3. 03

Preparing the application and business plan: Enter the road type and route, type of works, section and period, and purpose and reason of the works in the road works permit application, and set out the scope, schedule and cost-bearing plan in the business plan. If consultation with the road authority takes place during a building permit or development activity permit, the Article 36 permit is deemed granted, so the road works documents are prepared together at that application stage.

  4. 04

Attaching design documents: Design documents covering road structure, pavement, drainage and safety facilities are prepared by a designer and attached to the application, and the section and period in the application and business plan are checked against the drawings.

  5. 05

Filing and responding to supplementation requests: The statutory processing period after filing with the road authority is 15 days, and when the permit is granted the road authority publishes the section, period and purpose of the works. If supplementation is requested, the drawings and business plan are revised and resubmitted within the period. The fee is one-thousandth of the construction cost (excluding land and compensation costs), or the amount set by ordinance where the local government has set one.

  6. 06

Commencement report and completion inspection: Submit the road works commencement report within 5 days of starting the works, and on completion apply without delay for the completion inspection with the completion report, design documents and cost settlement statement attached. For works that change the road register, the implementer prepares the road register and submits it to the road authority after completion.

Starting access road works before the permit can lead to criminal penalties as well as orders to stop work and restore the site, so put the works permit, commencement report and completion inspection into the construction schedule first.
