Requirements for Resolution of School Violence Cases by the School Principal — 4 Conditions and Points to Check Before Written Consent
Resolution by the school principal is a system for closing minor school violence cases at the school without convening the School Violence Countermeasures Deliberation Committee (Deliberation Committee). All four requirements in Article 13-2 of the Act on the Prevention of and Countermeasures against Violence in Schools must be met, and the victim student and guardian must consent in writing. Once consent is given, it is difficult to demand a Deliberation Committee meeting for the same case, so check the facts before signing.
Procedure
1. Case investigation by the dedicated body
The school's dedicated body for school violence investigates the reported case and takes statements from the victim and aggressor students and their guardians. The written confirmations and statements made at this stage form the basis for deciding whether the requirements for the principal's resolution are met.
2. Checking the four requirements
All of the following must be met: there is no medical certificate stating that physical or mental treatment for 2 weeks or more is needed; there is no property damage, or the damage has been restored immediately or restoration has been promised; the violence is not continuous; and the act is not retaliation for a report, statement or similar act. A medical certificate for less than 2 weeks or a simple doctor's note can still satisfy the requirement.
3. Written consent of the victim's side
Even when the requirements are met, the case is closed by the principal's resolution only if the victim student and guardian confirm in writing that they do not want the Deliberation Committee to be convened. If the victim's side wants it, the school must convene the Deliberation Committee.
4. Recording what was agreed
If anything was promised, such as treatment costs, counseling costs or compensation for belongings, have it kept as an official record through the dedicated body. Whether the promise is kept becomes the basis for a later request to reopen the case.
5. Checking whether the case can be reopened
If the offending side promised to restore property damage and did not do so, or if facts not confirmed during the investigation are newly confirmed, the victim's side may request in writing that the principal convene the Deliberation Committee. It is difficult to withdraw consent for other reasons.
