How to Collect Evidence as a Victim of School Violence — KakaoTalk Screenshots, Medical Certificates and Statement Records, in Order
A school violence report does not need perfect evidence from the start. The consistency and specificity of the child's statement, diaries and notes, friends' statements and psychological changes also serve as supporting materials. However, messenger and social media materials are hard to recover once the other party deletes them or closes the account, so the first step is to preserve them right away on the day you learn of the harm.
Procedure
1. Preserve digital materials first
For KakaoTalk, Instagram DMs, text messages, comments and group chat conversations, capture the whole screen so that the other party's account, the date and the time are visible. Also keep the exported chat file and the original device.
2. Obtain a medical certificate and a written opinion
For physical harm, obtain a medical certificate of injury. For verbal violence or cyberbullying, obtain a written opinion from psychological counseling or medical treatment. If there is a medical certificate stating that treatment for 2 weeks or more is needed, the case is excluded from resolution by the school principal.
3. Record the child's statement
When the child is comfortable talking, write down in order the date, the place, what was said and done, and who saw it. Avoid blaming questions such as 'Why didn't you tell me earlier?' and questions that suggest the answer.
4. Report to the school and request preservation of materials
When reporting to the school, request in writing that CCTV and other video footage be preserved. The victim student and guardian may request the school's dedicated body to conduct a fact-finding investigation in order to confirm the facts of the harm.
5. Organize the statement of the facts of harm
Bundle the collected materials in date order, link each item to the harm it shows, and write the statement. These materials are used as they are in the school's investigation, before the Deliberation Committee and in later procedures for challenging the decision.
Required documents
- No submission form (this is the evidence-gathering stage; when reporting, attach the evidence to the school's school violence report form)
- Messenger and social media screenshots and exported chat files
- Medical certificate of injury, or a written opinion from psychological counseling or medical treatment
- Record of the child's statement, diaries and notes
- Summary of statements by students who witnessed the events
- Written request for preservation of CCTV footage
- Statement of the facts of harm (guardian's written confirmation)
Fees
Fees for preparing documents for the victim student's side in a school violence case generally run in the industry from several hundred thousand won to the 1,000,000 won range, and vary with the volume of materials and the scope of the response to the Deliberation Committee. We will advise after a consultation, based on the case.
Legal basis and review date
- Act on the Prevention of and Countermeasures against Violence in Schools, Article 2
- Act on the Prevention of and Countermeasures against Violence in Schools, Article 13-2
- Act on the Prevention of and Countermeasures against Violence in Schools, Article 14
Check these first
- Contacting the other student's side directly to confront them, or posting the case on social media, can make the dispute bigger instead, so preserve the materials and report to the school first.
