Software Business Operator Report and General Status Management Certificate — 7-Day Processing, 50,000 won New Application Fee

What is commonly called a software business operator report is, under Article 58 of the current Software Promotion Act and Article 17 of its Enforcement Rule, an application for management of the general status of a software business operator. The application uses Form No. 25 of the Enforcement Rule, and under a Ministry of Science and ICT guideline the Korea Software Industry Association receives applications and issues certificates as the business performance management institution. Processing takes 7 days, the fee is 50,000 won for a new application and 30,000 won for a change, and the general status management certificate itself is issued free of charge. The certificate shows sales (including software sales), the number of regular employees and software engineers, business fields and the lower limit amount for participation in public software project bids, based on the closing year, and project performance to be used for public contracts is registered through a separate performance management application.

Procedure

  1. 1. Check the business field and who should apply

The application lists 4 business fields: computer-related services, package software development and supply, digital content development services, and database production and search services, and you may select several fields that you actually operate or plan to operate. The form's instructions show the industry codes used when bidding on Public Procurement Service projects (1468, 1426, 1469 and 1470) for each field. Choose fields that match both the industry required by the bid notice and the work the company actually does.

  2. 2. Prepare the closing financial and staffing figures

The financial status section uses the figures from the most recent closed fiscal year, entering assets, liabilities, capital, sales, operating profit, net profit and R&D expenses in millions of won, with software sales stated separately. The number of regular employees is based on the previous year's closing, and the number of software engineers who fall under Article 2, Subparagraph 10 of the Software Promotion Act and Article 2 of its Enforcement Decree is entered as well. If all sales come from software business, mark full-time software business; otherwise mark combined business.

  3. 3. Complete and submit the general status management application

On Form No. 25, the software business operator general status management application, enter the large or small and medium enterprise classification, whether the company belongs to a business group subject to cross-shareholding restrictions, and, if there was a business transfer or merger, the transferor company's details. If you consent to shared use of administrative information, the management institution checks the corporate register, business registration certificate, closing financial statement certificate and SME confirmation itself, and a mid-sized enterprise attaches its mid-sized enterprise confirmation. Applications can also be filed through the Software Industry Information Comprehensive Management System.

  4. 4. Receive the general status management certificate

Once the management institution verifies the application, it issues the software business operator general status management certificate under Form No. 27. The certificate shows the company name, representative, location, sales, number of regular employees and software engineers, business fields and the lower limit amount for participation in public software project bids, based on the closing year. The certificate takes effect on the date of issue, and when a changed certificate is issued the earlier certificate loses effect.

  5. 5. Register project performance and file change applications after closing

To have software project performance with public or private clients managed, submit Form No. 26, the project performance management application, with the contract and documents confirming the performance, classified as new, change or completed, and obtain the project performance certificate under Form No. 28 when needed. If any registered information changes, file a change application, with financial status based on the latest closing.
