Video Production Business Report in Korea: Who Must Report and What to File — Using the Report Certificate for Video Production Service Direct Production Confirmation
A business that produces videos to distribute to, or provide for viewing by, an unspecified number of people must report a video production business to the mayor, county head or district head under Article 57 of the Promotion of the Motion Pictures and Video Products Act. You file the report form with a copy of the business premises lease (if leased) and a list of production facilities and equipment, and you receive a Video Production Business Report Certificate. Production intended only for viewing through information and communications networks, and commemorative videos of ceremonies or religious rites that are not distributed to the public, among others, do not need to be reported. Small and medium enterprises that want to supply video production services to public institutions can have the advance on-site survey waived and be recognized as meeting the standards for direct production confirmation if they hold this report certificate. Operating without reporting is punishable by a fine of up to 10,000,000 won, and failing to file a change report within 30 days after a change of representative, location, production items or trade name is subject to an administrative fine of up to 10,000,000 won.
Procedure
1. Check whether a report is required
Production by the national or local governments, production by educational institutions for their own training, production by broadcasters for broadcasting, production by public institutions to promote their own work, commemorative production of ceremonies or religious rites (except for public distribution), production and distribution intended only for viewing through information and communications networks, and production for purposes other than distribution or viewing by an unspecified number of people can be done without a report. If you distribute videos or provide them for viewing beyond this scope, a report is required. If you plan to use the report certificate for direct production confirmation, ask the city, county or district office in advance whether the report will be accepted.
2. Organize the premises and production equipment
If the business premises are leased, prepare a copy of the lease, and list the filming, editing and audio equipment you own or lease in a statement of production facilities and equipment. The official checks the corporate register and the certificate of business registration through shared administrative information, and you attach the certificate of business registration yourself if you do not consent to that check. A person who received a business closure order less than 1 year ago or is under a business suspension cannot report the same type of business.
3. Submit the report and receive the certificate
Submit the Video Production Business Report (Enforcement Rule Form No. 20) with the attachments to the city, county or district office. Once the report is accepted, you receive the Video Production Business Report Certificate (Form No. 23), and if it is lost or damaged you apply for reissuance with Form No. 27.
4. Apply for direct production confirmation for video production services
An SME that wants to supply public institutions applies for direct production confirmation through the SME public procurement information network, and the commissioned agency confirms it after an on-site review within 14 days (excluding Saturdays and public holidays) from the application date. The Standards for Confirmation of Direct Production of Products Competed for among SMEs provide that, where a company holds a Video Production Business Report Certificate, the advance on-site survey may be waived and the company may be recognized as meeting the standards. The direct production confirmation certificate is valid for 2 years from the date of issuance.
5. Change reports and follow-up
If the representative, business location, production items or trade name changes, file a change report (Form No. 28) with the report certificate and supporting documents within 30 days from the date of the change. For the direct production confirmation certificate, a change of trade name or of a corporation's representative requires reissuance, and reasons such as a change of an individual business's representative or relocation of the confirmed factory require returning the certificate and reapplying within 30 days.
