Alien Registration and Extension of Stay

Under Article 31 of the Immigration Act, a foreign national who intends to stay for more than 90 days from the date of entry must, unless exempt, complete alien registration at the immigration office with jurisdiction over the place of stay within 90 days of entry. After registration, if the name, sex, date of birth, nationality or passport details change, a report of change of registered items must be filed within 15 days under Article 35 of the same Act, and after moving, a report of change of the place of stay must be filed within 15 days of moving in at the new city, county, district, town or neighborhood office or immigration office under Article 36. An extension of stay is applied for before expiry with documents proving activities and a place of stay that fit the current status. To engage in activities different from the current status, a change of status must be approved before starting them, so first distinguish whether an extension or a change is needed.

Procedure

Procedure

  1. 01

Check the target and deadlines: Check the date of entry, current status, permitted period of stay and actual activities. Determine whether the person is exempt from alien registration and which of registration, extension or change of status is needed, and set the document preparation and filing schedule around the expiry date.

  2. 02

Apply for alien registration: To stay longer than 90 days, submit the integrated application form, passport, photo and proof of the place of stay to the immigration office with jurisdiction over the place of stay within 90 days of entry. If a new status is granted in Korea and the stay will exceed 90 days, registration is done at that time.

  3. 03

Report changes of registered items and address: If the name, sex, date of birth, nationality or passport number, issue date or validity changes, file a report of change of registered items within 15 days, and after moving, report the change of the place of stay at the new community service center or immigration office within 15 days of moving in.

  4. 04

Prepare and submit extension documents: Prepare the passport, alien registration card and proof of the place of stay, and check the documents required for the current status, such as a certificate of enrollment or employment contract. Check whether HiKorea online filing is available and the visit booking schedule, and apply before the period of stay ends.

  5. 05

Approval for a change of activities: To engage in activities different from the current status, such as working after finishing studies, obtain a change of status before starting the activity. An extension application cannot substitute for the new activity, so first check whether a change is required.

  6. 06

Supplements and results: If a supplement request is received after filing, submit materials matching the request, and if approved, check the permitted period shown on the alien registration card. If denied, check the reasons and the departure deadline in the notice and decide within the deadline whether to supplement and reapply or file an administrative appeal.

Staying beyond the expiry date of the period of stay results in illegal stay, so the filing schedule should be set early enough to complete the extension application before expiry even when visit bookings are backed up.
