Prior Report of Specified Construction Work and Fugitive Dust-Generating Business Report

Before breaking ground, a construction site must file two environmental reports with the mayor, county head, or district head with jurisdiction over the site. The prior report of specified construction work under Article 22 of the Noise and Vibration Control Act applies to work that uses equipment listed in Appended Table 9 of the Enforcement Rule, such as excavators, breakers, and pile drivers, for 5 days or more, and that involves building construction with a total floor area of 1,000㎡ or more, demolition of 3,000㎡ or more, earthwork of 1,000㎡ or more, and similar; the authority notifies acceptance within 4 days of receipt. The fugitive dust-generating business report under Article 43 of the Clean Air Conservation Act applies to building, civil engineering, and demolition work at or above the scale in Appended Table 13 of that Act's Enforcement Rule, and dust control facilities such as dust barriers and wheel-washing facilities meeting Appended Table 14 must be installed. For contracted work, the party that first received the contract from the client files the report; work using only certified low-noise equipment or work in excluded areas such as industrial complexes is not subject to the prior report of specified construction work.

Procedure

Procedure

  1. 01

Checking whether the prior report of specified construction work applies: First check whether Appended Table 9 equipment such as pile drivers, drills, air compressors, breakers, excavators, generators, loaders, or concrete cutters will be used for 5 days or more. The report is required for building construction of 1,000㎡ or more, demolition of 3,000㎡ or more, civil works with a volume of 1,000㎥ or an area of 1,000㎡ or more, earthwork or site grading of 1,000㎡ or more, or boring work with a total length of 200m or more, or for work within 50m of the boundary of a school, apartment complex, or general hospital or in a residential zone.

  2. 02

Checking whether the fugitive dust report applies: Building construction (including extensions, alterations, and major repairs) with a total floor area of 1,000㎡ or more, demolition of 3,000㎡ or more, earthwork or site grading of 1,000㎡ or more, and civil works with a structure volume of 1,000㎥ or more or a work area of 1,000㎡ or more are covered at or above the Appended Table 13 scale. Even if the work is split into separate contracts, the total scale is used, so the areas of split contracts are added together.

  3. 03

Preparing the work outline and mitigation measures: Prepare a work outline with the purpose and schedule, a location map marking affected receptors such as nearby housing, and specifications and drawings of soundproofing and vibration-proofing facilities. Mitigation measures such as low-noise methods and equipment, movable sound barriers, and adjusted working hours are written to match the work stages, and for fugitive dust the plan for dust barriers, wheel-washing facilities, and truck bed covers under Appended Table 14 is included.

  4. 04

Filing the reports before groundbreaking: File the prior report of specified construction work and the fugitive dust-generating business report with the environment division of the city/county/district with jurisdiction over the site before groundbreaking. For work subject to a construction commencement report under the Building Act, the fugitive dust report may be filed together with the business waste discharger report, and if the site spans two or more cities/counties/districts, the report goes to the one covering the largest work area.

  5. 05

Receiving the report certificate and filing change reports: For specified construction work, if no notice is given within 4 days, the report is deemed accepted on the day after that period ends. Increases of 30% or more in equipment, extension of the work period, or expansion of the work scale by 10% or more require a change report on Form No. 12, and an extension must be filed before the work period on the certificate ends. For fugitive dust, a change of name or representative is reported within 30 days, and an extension of the work period by the end date on the report certificate.
