Specific Construction Prior Report and Fugitive Dust Business Report — Works of 1,000㎡ or More in Total Floor Area Must Report Before Construction Starts

There are 2 reports a construction site files with the city, county or district environment department before construction starts. The specific construction prior report under Article 22 of the Noise and Vibration Control Act applies to works using equipment in Annex 9 of the Enforcement Rule, such as excavators, breakers and pile drivers, for 5 days or more, including building works of 1,000㎡ or more in total floor area and demolition of 3,000㎡ or more. The fugitive dust business report under Article 43 of the Clean Air Conservation Act applies to works at or above the scale in Annex 13 of the Enforcement Rule, such as building construction of 1,000㎡ or more in total floor area and earthworks of 1,000㎡ or more. For contracted works, both reports are filed before construction starts by the party that first received the contract from the client, with the mayor, county head or district head having jurisdiction over the site.

Procedure

  1. 1. Check whether a specific construction prior report is required

The starting point is works that use Annex 9 equipment such as pile drivers, drilling machines, air compressors, breakers, excavators, generators, loaders, crushers, compaction machines, concrete cutters and concrete pumps for 5 days or more. If the works also fall under building works of 1,000㎡ or more in total floor area, demolition of 3,000㎡ or more in total floor area, civil works with structures of 1,000㎥ or more in volume or 1,000㎡ or more in area, earthworks or grading of 1,000㎡ or more, or boring works of 200m or more in total length or 200㎥ or more of excavated soil, a report is required. Works within 50m of the site boundary of a school, apartment complex or general hospital, or in a residential area, are covered even without these scale thresholds, while works in industrial complexes, exclusive industrial areas and similar areas and works using only certified low-noise equipment are excluded.

  2. 2. Check whether a fugitive dust business report is required

A report is required for building construction of 1,000㎡ or more in total floor area including extension, reconstruction and major repairs, civil works with structures of 1,000㎥ or more, a work area of 1,000㎡ or more or a total length of 200m or more, landscaping works of 5,000㎡ or more, building demolition of 3,000㎡ or more in total floor area, and earthworks or grading of 1,000㎡ or more. Exterior painting of apartment buildings that establish a long-term repair plan is also covered. If works are ordered in parts, the total scale is used, and in areas such as within 50m of a school or apartment complex site boundary, local ordinances may extend coverage to smaller works.

  3. 3. Submit the reports before construction starts

For specific construction, submit the prior report (Form No. 10) with a work outline and schedule, a location map marking affected targets such as nearby houses, specifications and drawings of soundproofing and vibration-proofing facilities, and noise and vibration reduction measures. For fugitive dust, submit the report (Form No. 24) before construction starts, and if the works require a construction start report under the Building Act, you may submit it together with the business waste discharger report. If the site spans 2 or more cities, counties or districts, report to the one with the largest work area.

  4. 4. Install sound barriers and dust suppression facilities

Specific construction may start only after soundproofing facilities are installed, and sound barriers must reduce noise by at least 7dB and be at least 3m high. Exceptions apply where installing barriers in advance is difficult, such as narrow sites or demolition works. For fugitive dust, under Annex 14, install dust barriers at least 1.8m high at the site boundary (at least 3m if residential or commercial buildings are within 50m of the site boundary), and provide wheel washing facilities and cargo covers for transport vehicles.

  5. 5. Receive the report certificates and file change reports

For specific construction, you are notified of acceptance within 4 days of filing, and if no notice is given in time, the report is deemed accepted the day after the period ends. An increase of equipment by 30% or more, extension of the work period, changes to soundproofing facilities or reduction measures, and expansion of the work scale by 10% or more require a change report on Form No. 12, and an extension must be filed before the work period on the certificate ends. For fugitive dust, file a change report within 30 days of changing the name or representative, by the end of the work period on the certificate for an extension, and before the change for other matters.

Checked against the statutes on

Statutes and public notices change, so each case needs to be checked individually. Statute titles are given in English for reference. The Korean statutes are the authoritative text.

Check these first

  • A change report for extending the specific construction period must be filed before the work period on the certificate ends, so if work is delayed, file it ahead of the end date.
  • Even if works are ordered in parts, fugitive dust report coverage is judged by the total scale, so add up the full area for split contracts.

Frequently asked questions

Does remodeling work also require a specific construction prior report?
Yes, if it meets the equipment and scale or area criteria. If you use Annex 9 equipment such as breakers (including handheld) or concrete cutters for 5 days or more and the works meet a scale threshold such as building works of 1,000㎡ or more in total floor area, a report is required. Works within 50m of the site boundary of a school, apartment complex or general hospital, or in a residential area, are covered even at a small scale if the equipment is used for 5 days or more, so check the equipment schedule first.
Who files the specific construction prior report and fugitive dust report?
For contracted works, the party that first received the contract from the client files them. The prime contractor, not a subcontractor, is the reporting party, and if the site spans 2 or more cities, counties or districts, the report goes to the one with the largest area. The receiving authority notifies the authorities with jurisdiction over the other areas.
What happens if I build without a fugitive dust report or specific construction report?
You face fines or administrative fines. Failing to file a fugitive dust business report can lead to a fine of up to 3,000,000 won, and the city, county or district may order suspension of the business or use of facilities for up to 6 months. Failing to file a specific construction prior report or change report, or failing to install soundproofing facilities, is subject to an administrative fine of up to 2,000,000 won.
Do I need to report again if the work period is extended?
Yes, a change report is required. For specific construction, submit the change report on Form No. 12 before the work period on the prior report certificate ends, and for a fugitive dust business, file the change report by the end of the work period on the certificate. Failing to file a fugitive dust change report is subject to an administrative fine of up to 1,000,000 won.
Does an administrative agent handle specific construction prior reports and fugitive dust reports?
Yes. Hwang Yunsang Administrative Office reviews whether a report is required, prepares the specific construction prior report and fugitive dust business report, organizes the work outline, location map and reduction measure materials and submits them to the city, county or district on your behalf, and prepares change reports such as for work period extensions.
