Educational Environment Protection Zone Review (Exclusion of Prohibited Acts and Facilities)

Under Article 8 of the Educational Environment Protection Act, the area within 200 m in a straight line from a school boundary or planned school site boundary is an educational environment protection zone; the area within 50 m of the school gate is the absolute protection zone and the rest is the relative protection zone. Article 9 of the same Act prohibits acts and facilities such as lodging, singing rooms, game-provision businesses and karaoke bars in this zone, but in the relative protection zone, acts and facilities under items 14 to 27 and 29 to 32 are excluded from the prohibition when the superintendent of education or a person delegated by the superintendent, after review by the Local Educational Environment Protection Committee, recognizes that they do not harm learning and the educational environment. The application is filed with the competent local education office, the committee decides with at least two-thirds of the members present in favor, and the absolute protection zone and items 1 to 13 are not subject to review. The protection zone itself is not lifted by application; it loses effect when a reason under Article 8(4), such as closure or relocation of the school, arises, so obtaining an exclusion review for the prohibited facility is the usual procedure for operating a business.

Procedure

Procedure

  1. 01

Check the zone type and the applicable item: Using the zone notice map and the Educational Environment Information System, confirm whether the planned business site is in an absolute protection zone (within 50 m in a straight line from the school gate) or a relative protection zone, and which item of Article 9 the business falls under. Singing rooms and game-provision businesses are not prohibited in the first place within the protection zones of kindergartens and universities.

  2. 02

Decide whether review is available: Facilities in an absolute protection zone, and items 1 to 13 even in a relative protection zone (facilities exceeding emission standards, cremation and enshrinement facilities, slaughterhouses, restricted screening cinemas, establishments off-limits to youth, etc.), cannot be excluded through review. Lodging and tourist lodging (item 27), karaoke bars and entertainment bars (item 26), singing rooms (item 24), game-provision businesses including PC rooms (item 19) and tobacco retail (item 18) are eligible for review.

  3. 03

Prepare site condition materials: Draw a location map marking the school and the planned business site, and organize, with photos, the straight-line distance to the school, school routes and entrance direction, roads and buildings in between, business hours and signage plans so that the committee can judge the effect on learning and the educational environment.

  4. 04

Prepare and file the exclusion application: Attach the location map and, if there is no building register, the facility or architectural design drawings to the application for exclusion from prohibited acts and facilities (Enforcement Rule Form No. 2) and file it with the competent local education office. The building register and land use plan confirmation are checked through administrative information sharing; if the applicant does not consent, they are attached directly.

  5. 05

Local committee review and notice of result: The Local Educational Environment Protection Committee decides on exclusion with a majority of all members present and at least two-thirds of the members present in favor. The chair may have the head of the related school attend to give an opinion, and requests to observe from school steering committee members or parents are in principle allowed. The result is notified to the applicant using Enforcement Rule Form No. 3.

  6. 06

Re-review period and business licensing: The head of a school that objects to the result may request a re-review through the school steering committee within 10 days of learning of the result, and the committee reviews again within 15 days of receiving the request. After receiving an exclusion decision, the business report or permit is filed with the relevant administrative agency such as the city, county or district office.

If you sign a lease or start interior work before the exclusion decision, the costs are hard to recover if the exclusion is refused, so check the zone type and review eligibility before signing.
