Closing Out Remaining Permits After a Factory Relocation or Sale (Change, Closure and Succession Reports)

Even when a factory is relocated or sold, the factory registration, air and wastewater discharge facility permits or reports, hazardous materials facility permits and toxic chemical business permits held in the name of the former factory are not cleared automatically and must be reported separately under each law. If the equipment is removed, closure or abolition reports are filed; if another company continues to use it, a succession report is filed. Air emission and prevention facilities require a change report before closure, the closure of all wastewater discharge facilities requires a change report within 30 days of closure, and hazardous materials facilities require a report to the city or provincial governor within 14 days of abolishing their use. When registered factory details change, a change registration must be applied for within 2 months under Article 16 of the Industrial Cluster Development and Factory Establishment Act.

Procedure

Procedure

  1. 01

List the permits: Find all permits remaining in the name of the former factory, such as the factory registration ledger, air and wastewater discharge facility permits or report certificates, hazardous materials facility permits, toxic chemical business permits and business waste discharger reports, and organize the competent authority and current status of each in a table.

  2. 02

Distinguish removal from succession: If the equipment is removed and the business ends, closure or abolition reports are required in each field; if another company takes over and continues to use the factory and equipment, the transferee must file succession reports. A company that acquires the facilities through auction or the sale of seized property also succeeds to the status.

  3. 03

Air and wastewater discharge facility reports: For air emission or prevention facilities, submit a discharge facility change report before closure; for wastewater discharge facilities, submit a change report before closure if part is closed, or within 30 days of closure if all are closed. If the workplace name or representative changes, file a change report within 2 months.

  4. 04

Hazardous materials and toxic chemicals: For hazardous materials facilities, file an abolition report within 14 days of abolishing their use, and the acquiring company files a succession report within 30 days of succession. For a toxic chemical business, dispose of the remaining toxic chemicals first and then file a closure report, and the acquiring company files a succession report within 30 days.

  5. 05

Factory registration change or cancellation and industrial complex matters: If registered details such as the company name, site area or industry change, submit a factory registration change application to the city, county or district within 2 months, and consulted items such as hazardous materials succession or discharge facility change reports may be processed at the same time. Companies in an industrial complex settle their occupancy contract with the management agency, and the business closure report to the tax office is filed by the applicant directly through Hometax or at the tax office.

The closure of air emission and prevention facilities and the partial closure of wastewater discharge facilities must be reported before closure, so the change reports should be filed before scheduling the removal of equipment.
