Imported Construction Machinery Type Report and Same-Type Import Report

Under Article 18(2) of the Construction Machinery Management Act, anyone importing construction machinery must obtain type approval from the Minister of Land, Infrastructure and Transport, but the machine types listed in Article 11 of the Enforcement Decree, such as bulldozers, forklifts, rollers and crawler-type excavators, loaders and cranes, may instead file a type report. When importing equipment of the same type as one already approved or reported, a same-type import report under paragraph (4) of the same Article is filed, and approval or reporting may be skipped for research and development or export purposes. Under Articles 44-2 and 46 of the Enforcement Rule, reports are filed with the Korea Transportation Safety Authority or a designated inspection agent (tower cranes: inspection agent only); acceptance is notified within 10 days of receipt, and if no notice is given in that period the report is deemed accepted on the day after the period ends. Even for the same machine type, the travel system matters: wheel-type excavators and loaders require type approval.

    Classify the machine: Check the machine type and travel system (crawler or wheel) to decide whether it requires type approval or falls under the type-report list in Article 11 of the Enforcement Decree, and check whether the R&D or export exception applies.

    Check existing types: Before shipment, confirm whether the same manufacturer and model type has already been approved or reported in Korea. If so, prepare a same-type import report; if it is a new type, prepare a type report or type approval application.

    Cross-check the specification sheet and technical data: Compare the construction machinery specification sheet (Form No. 3 series), the external view drawing, and the test reports or certificates issued by the manufacturer or an accredited testing institute against the items of the Rules on Safety Standards for Construction Machinery.

    Prove after-sales service capacity: When reporting the type for the first time, prepare documents showing the after-sales facilities and technical personnel required by Article 56 and Annex 13 of the Enforcement Rule, together with how spare parts and maintenance data will be supplied.

    File the report: Submit Form No. 26 with attachments to the Korea Transportation Safety Authority or an inspection agent. A same-type import report attaches the specification sheet and a copy of the shipping documents; a type report attaches the external view drawing and safety-standard conformity documents.

  6. 06

    Inspection and registration after acceptance: If a confirmation inspection is taken after acceptance, the machine is deemed to have passed the new registration inspection. Apply for registration with the city or province within 2 months of acquisition (for imports for sale, from the date of sale), and file a change report when type details change.

If a machine that requires type approval, such as a wheel-type excavator or loader, is prepared as a type report, the filing has to start over, so confirm the travel system and the applicable procedure before shipment. Unless a change is a minor one under Article 45 of the Enforcement Rule (cab shape, tire size, or parts that do not affect performance), do not omit the change report.
